  2. Paul is not going to jail.

    Gunderson is already there.

Paul will offer another deal at this point.

  3. Defense rests already? I guess that would be a good thing.

  4. It surprises me, too, Fred. But I guess you have to ask, what was there to refute? We don't have access to the transcripts, so all we know is what's in the papers, but it looks like all the testimony was about Darcie Seal's testimony - what did she say, and when, is she saying one thing one day and one thing another day, was she suffering from Stockholm syndrome...how raunchy could it get - and still no word about Lunesta. The trial was more of an investigation than a trial it seems.

  5. I'm breathless with anticipation .........

It the jury doesn't convict on the rape PVG is going to look really bad, as will office. The investigation was fubar'd from the start.

The real winner is Russ Clanton. $$$$$$$$$$$$$$$$$$$$$$

  6. Convict? Hell there was reasonable doubt before it started. Clanton was to easy on Gallegos for not hammering more on Joan.

  7. Paul will be lucky to get a conviction on the gun charges. Sounds like the only thing Gunny could be hung on was breaking Blue Lake policy and he's not on trial for that. In the end Paul gets what he went after.....and end to Gunny's career.

  8. Now that you mention it, I don't believe I've ever heard the specific charges regarding the firearms.

  9. Reading this morning's news it seems to confirm what I've suspected. That being that these firearms charges are simply paperwork related in regards to how he purchased the guns. Peace officers are allowed to own automatic weapons in California. There's also been testimony that they were fired at the C/R Police Academy range. Maybe not fully documented training, but close enough for me.

With two witnesses (according to the Eureka Reporter this morning) having different opinions as to whether the weapons needed to be registered with whatever agencies, I'd say there's doubt as to guilt in even paperwork violations.

It's looking pretty good for Gunderson, to me, but that's just from the not- so- close attention I've been paying to what's been in the papers.

As an aside, I find it rather odd that the investigators in this chose to bring up the weapons. A lot of cops up here have such firearms and you can bet they themselves could probably be charged for the same thing Gunderson was charged with by not having someone's idea of the right paperwork filled out.

  10. wait a minute. Clanton is the defense lawyer. Therefor, PVG was
half-way to a conviction when the case started. In a battle to the bottom of the barrel, Clanton
wins. By a nose, but he wins.
    So Gunderson may lose.

  11. Half way to a conviction? The entire burden was on PVG. He started out at 0%. Looks like he is ending up there. It only takes a reasonable doubt to be acquitted. But I agree both are bottom feeders.

  12. The FBI guy cleaned the DA's clock. How is it, given the unimpeachable facts regarding police gun use, that these charges were ever brought? Does NO ONE in the DA's office know ANY laws? Or at least ask about them? Or is it shoot first, ask later in these here parts?

Remember, they have their own assault weapons. Admittedly, unsilenced (? as far as we know)
semis (as far as we know) but shouldn't they know the law? And if they don't, wouldn't asking the FBI/ATF been a good place to start
    prior to filing felony charges?

  13. You would think so. Just about gives credence to my, and others, suggestions that this was just a way to pile on charges in hopes Gundersen would plead guilty to some of them.

    What a mess!!!

  14. I think you're right Fred.

While I believe there are some really troubling dimensions of the gun stuff, particularly the web site gun sales stuff.

But, you haven't considered the possibility that this is a matter of professional jealousy. Does the DA SWAT team have a Heckler and Koch MP5 submachine gun?

Now that Gunderson is out of police work, where does that little gem go?

Seriously, there are some really disturbing aspects of this case. But, I think it was vastly over charged...immunized key witnesses recanting, the DA's wife representing the chief accuser of the defendant and the colossal bail.

I wouldn't hire Gunderson to paint my house but I think he's a victim too.

  15. What website gun sales? There was mention of a Myspace site that indicated that they sold arms. Not one mention of any sales. All kind of bragging bullshit is posted on Myspace.
