After a ten minute court hearing this morning in which Judge Timothy Cissna made a Court finding that Jason Warren's prior juvenile allegations were true and considered a strike under the three strike law, a sentencing date for Warren for set for January 14 at 8:30 a.m.

He also added some context to the dry legal definitions. Murder in the first degree requires malice aforethought, whether implied or express, Sequeira said. Like if you were to “smash someone’s head with a sword,” he added, referencing the alleged murder weapon in Ulrich’s death.

Lying in wait involves concealing your purpose and waiting for an opportunity to act before unleashing a surprise attack. That doesn’t necessarily mean a bad guy jumping out from behind a bush, Sequeira said. It could be someone who was hanging out with the victim all day, as Warren did with Ulrich.

Premeditation and deliberation, Sequeira said, is about the process of making a decision.

“We all know that Dorothy Ulrich made a fatal mistake in that she brought the defendant into her house,” he said.

While the prosecutor said he had decided not to replay the audio capturing the sounds of the assault that killed Ulrich, he pointed to that four minutes of pain, fear and desperation as torture, one of the special allegations Warren faces. That argument continued with attention on two wounds the medical examiner found on Ulrich’s chest.

“They’re not very deep,” he said. “They’re like jabs and pokes. Who does that unless they intend to inflict long and extended pain?”

Today, a trial confirmation hearing was scheduled for the Jason Warren case at 4 p.m. He was served with a copy of a document by the People in court today, before he left. Alternate Conflict Counsel's Mr. Glenn Brown is representing Warren in the Hoopa case where is charged with the homicide of Dorothy Ulrich.

If the case gets assigned Friday, it will start Monday in Courtroom 4. While the case has been assigned to Judge Timothy Cissna for trial, the decision if it will definitely start on September 28 depends on how trial assignment goes this Friday. As Judge Cissna explained, "there maybe other higher priority cases."

It all depends on courtroom availability....

Schedules, witness list and the gag order and freedom of the press was discussed this afternoon.

Time estimate including jury selection is 8 to 10 weeks. Trial is expected to be over by mid-December. The proposed schedule is Monday to Thursday from 8:30 to noon; Tuesdays and Thursdays 1:30 to 4 or 4:30 and every other Friday.

Due to court holidays, the trial will not be in session on October 12, November 11, November 26 and November 27....

The jury trial is scheduled for September 28 with a jury panel scheduled for September 29.

Mr. Kevin Robinson from the Public Defender's office is representing Warren in the Eureka case in which he is also charged with the death of Suzanne Seeman and attempted murder of severely injuring two other joggers who were with her. Mr. Robinson has not been present for the last three hearings since the case going to trial is the one in which (Alternate Conflict Counsel's Mr. Glenn Brown) is representing Warren.

Mr. Paul Sequeira, Assistant DA from Mendocino County, is a special prosecutor for this case. He asked Judge Cissna for specifics of the gag order which was issued before he took the case. Ms. Fleming also mentioned it was a general gag order and wanted some clarification. Both have received questions from the press. After nearly three years of pretrial hearings, the double murder trial against Jason Anthony Warren, 31, is now likely to proceed into jury selection at the start of next week, according to Humboldt County Superior Court Judge Timothy P. Cissna during a Wednesday afternoon hearing.

While Cissna was officially assigned on Tuesday to hear the trial, the case must still be assigned out to a courtroom, which is set to occur Friday morning.

“I don’t know whether it will get assigned out or not,” Cissna told the attorneys in his courtroom. “... If it is assigned out, we should be ready to proceed on Monday.”

...The trial is estimated to last eight to 10 weeks, including jury selection, if it follows the schedule agreed upon by attorneys and Cissna. Cissna said this schedule would have the trial finished “well before Christmas.”

But due to factors such as the length of the witness list, past media coverage of the case, the length of the trial, and the fact that the trial would occur around the holiday season, Warren’s attorney Glenn Brown of the county Alternate Counsel’s Office said selecting jurors may take much longer than anticipated.

“It’s just an unknown at this point,” Brown said.

Public Defender Kevin S. Robinson lost his recent motion for separate proceedings in connection with Warren’s alleged beating death of Dorothy Evelyn Ulrich, 47, of Hoopa in the early morning of Sept. 27, 2013; and the alleged vehicular murder shortly thereafter of Humboldt State University geography instructor Suzanne Seemann, mother of two, on Old Arcata Road/Myrtle Avenue, Eureka.

Warren is accused of deliberately running down Seeman and her two jogging companions, Jessica Hunt and Terri Vroman-Little. He allegedly plowed into them in a silver 2005 Kia Spectra he is alleged to have stolen from Ulrich. Both Hunt and Vroman-Little were gravely injured but survived.

Warren is to be prosecuted on four counts, one for Ulrich and counts two, three and four for the other three victims.

...The letter signed by Hank Seemann, Jessie Hunt and Terri-Vroman-Little dated August 21, 2015 was sent to Humboldt County Superior Court Interim CEO Mike Tozzi, DA Maggie Fleming, Holly Hensher, from Victim Witness, and two Judicial Council officers, Tani Cantil-Sakauye and Martin Hoshino.

It refers to the Jason Warren case and the current scheduled trial date of September 14, in the letter they state that "we understand that a Judge has not been assigned for this case and there is substantial risk for postponement of the trial until 2016 due to lack of an unavailable judge in Humboldt County."

They ask that all possible options be explored with the Judicial Council to secure an available judge from a neighboring county or a travelling judge.

They talk about the fact that the case has had numerous delays and the impact it has had on their families. The three year anniversary is coming up....

...With little attention or fanfare, Humboldt County District Attorney Paul Gallegos is seeking the death penalty against Jason Anthony Warren in a case scheduled to go to trial in May. If a jury ultimately convicts and condemns Warren, it would be the first time Humboldt has sent someone to death row in nearly 25 years....

The 29-year-old, who has a violent history, stands accused of torturing and killing a Hoopa woman, Dorothy Ulrich, on the morning of Sept. 26, 2012 before taking a car from her residence and driving to Eureka, where he allegedly intentionally hit three runners, killing Suzanne Seemann and seriously injuring Jessica Hunt and Terri Vroman-Little. A gag order was issued in the case shortly after Warren was charged, preventing officials from speaking publicly about the case. Consequently, Gallegos has been unable to explain his rationale for pursuing the death penalty for the first time in his tenure as DA....

During the first debate in the race to replace Gallegos next year, the four candidates — Allan Dollison, Elan Firpo, Maggie Fleming and Arnie Klein — were asked for their thoughts on the death penalty.

Dollison, a former deputy district attorney and a lieutenant colonel in the Army Reserve, said he supports capital punishment in limited cases. "It should be on the table," he said. Fleming, also a former deputy district attorney now working in County Counsel's office, generally agreed, saying it's a "most-extraordinary punishment" that should be reserved for certain cases. Fleming noted that, in her decades as a prosecutor, she never once felt it was appropriate for a case she was handling.

On the other end of the spectrum, Firpo said plainly she's against capital punishment. "I don't think civilized societies kill people for killing people," she said. "It just doesn't make sense." Klein, who has a 40-year history in criminal law including 20 years as a prosecutor, offered a scattershot answer. First, he said he used to believe in the punishment, noting he was a young prosecutor who felt he had God on his side and believed cops never lied. But, Klein said, he's "evolved" and now prefers pursuing a sentence of life imprisonment without the possibility of parole. He also noted that in California, "we don't really have a death penalty, so seeking one doesn't make sense."

...Thad explained that the decision to seek the death penalty against Warren was not a recent one and that Paul made that call a while ago, Thad thinks possibly even before the preliminary hearing. There is a gag order in the case and Thad mentioned since not all reporters can show up for every hearing, not all of us may know about the gag order. This is true, I have seen that myself. One of the reasons I chose to go to every hearing in a case I cover.

Thad wanted to stress Paul did not release this information to him....

There is a death penalty policy that the Humboldt County District Attorney's office has and due to space, Thad could not include it in the story. While he shared it with me, I did not get it from Paul nor does it have a date so Paul how do you come to these decisions involving a person's life?

So much time has gone by, and only now this comes out. Do we have the manpower or the resources for this case? Does he have time to try this between now and December? Remember, he leaves in January. This case will end up dropped in the lap of the incoming DA - another f-up for them to deal with. IMO

Paul Gallegos gets continuance in defense request to dismiss Warren case

...Defense filed a motion to dismiss certain counts. Judge John Feeney presiding in Courtroom 1, Kevin Robinson representing Jason Warren and District Attorney Paul Gallegos is prosecuting the case.

Today oral arguments were supposed to be heard on a 995 Motion. A California Penal Code 995 motion is a request for the judge to dismiss one or more counts of the complaint. A motion to dismiss can be filed after a preliminary hearing on a felony case.

The defense was requesting that counts 2, 3 and 4 be dismissed. Mr. Gallegos asked the court to review all exhibits in the case before the 995 hearing and making a decision. Judge Feeney agreed and granted Mr. Gallegos' request. The defense and Warren submitted on the continuance.

The oral arguments will be heard on March 27 at 3 p.m.

The California Highway Patrol says Jason Anthony Warren murdered Suzie Seemann, the university professor who died when a Kia allegedly driven by Warren ran into her and two friends on the morning of Sept. 27 as they went for their morning jog on Old Arcata Road. Her friends, Jessica Hunt and Terri Vroman-Little, suffered major injuries, and Hunt’s dog, Maggie, also was killed....

In November, the Humboldt County Sheriff’s Department asked the DA to file homicide and auto theft charges against Warren for a separate incident — the killing of Hoopa resident Dorothy Ulrich — earlier on the same morning the joggers were hit.

Charges sought are, one count of 187 (a) PC (Murder), two counts of 664/187 (a) Attempted Murder, one count of 597 (a) PC Animal Cruelty, three counts of 245 (a) (1) PC, Assault with a Deadly Weapon, and one count of 10851 (a) VC, Vehicle Theft.

No further informational releases will be made through this office, pending adjudication of this case.

...Based upon their investigation, Sheriff’s detectives believe Ulrich was killed during the early morning hours of September 27, 2012. A silver Kia Spectra was stolen from Hoopa shortly after Ulrich’s death. Subsequently, the Silver Kia Spectra was recovered by the Eureka Police Department in the City of Eureka on Sept. 27, 2012.

Jason Warren is currently in custody at San Quentin State Prison on an unrelated charge.
