The opposite of whining and crying:
History-rich Oberon Grill returns to Old Town
EUREKA -- “It happened on a warm Saturday evening, spring of 1910. I was there.”
So reads the framed letter, dated July 20, 1966, that hangs on the back wall in the Oberon Grill, an upscale new restaurant and bar in Old Town. Written by a Eureka resident named W.J. “Hap” Waters, the letter recalls in vivid detail the fight that took place that warm Saturday evening, now nearly a century past, between Eureka timber man Stanwood Murphy, whose family controlled the town's main industrial power, the Pacific Lumber Co., and an author traveling through town by the name of Jack London.
The fight took place inside the Oberon, Waters writes, a bar and brothel located across from the Vance Hotel. It was a knock-down, drag-out tussle, the letter says, sparked by political debate -- Murphy being described as a “Conservative Republican” and London a “confirmed Socialist.”

Both sides now ...w/update(s)
KSLG's John Matthews interviewed both Larry Glass and the Arkley family spokesperson, Steven Glazer, regarding the AG's decision... (Hank has dubbed it Push comes to Shove)
First, Glass: I've pretty much heard Larry Glass' side before, but there were a few new things.. he sure is mad at the Times Standard, calls them "despicable" - laughs that he got better treatment from the Eureka Reporter, says Heather Muller's coverage was accurate and that he tips his hat to Glenn Franco Simmons, says he went out of his way to give a fair presentation, without spinning it. I actually thought the Times Standard's coverage was fair, the letters and cartoons may be what he is referring to, but, ok.
Says he had stuff leaked to him, which begs the question 'who and when?'
Says he stood up and did what he had to do, It's water under the bridge now.
Larry didn't pull any punches. Everyone who listens to it will take away from it what they want. I'd say one thing, Larry, being a public official isn't the same thing as chatting at the record store, some things oughtta just be kept close to the vest, and calling Arkley names and sneering at the Mayor of Orinda because he also happens to have a job as a PR guy... I don't know, that part is kinda beneath the dignity of your office.

Then, Glazer: I've read the reports, so I had a basic idea of what to expect. Obviously, the Arkley family is gratified to have an end to this. But Glazer didn't pull any punches, either. He talks about Larry acting at the behest of his "handlers" - changing his mind about pressing charges (Which I agree with, after listening to Larry's first interview way back when and watching the subsequent events unfold.) He talks about Larry's anti-Marina Center crusade (which are also well documented) and questions his ability to set aside his bias with regards to the Marina Center Project.
Richard Salzman's anti-Arkley stickers are a big part of the story, as Richard knew they would be. But Salzman's antics actually bolster Glazer's argument that these were politically motivated charges brought by an individual with a long-standing grudge against the Arkley's. That single thing stands out.
One thing I've noticed is the spin on the blogs turning into "Of course the AG wouldn't prosecute a rich man." The absurdity of that, when the AG is a prominent democrat, and this case presented an opportunity to 'get' a major republican donor - it just strikes me funny to see the spin unfold. I do think Jerry Brown's integrity rises above that. And when the evidence wasn't there, he did the right thing.
John Matthews asks them both if Larry and Rob could sit down and have coffee some day. Maybe someday they can. In the spirit of - as Glazer says - of making Eureka the best it can be. Stranger things have come to pass.

I was listening to an interview with Eureka City Councilman Larry Glass on KSLG last week regarding the state attorney general's office's decision not to act on Glass' charge that businessman Rob Arkley threatened and shoved him.
In the middle of the interview, Glass launched into a tantrum about media coverage of the incident, saying, “The papers treated it as comic relief. The Times-Standard took great glee in trying to ridicule me by portraying me as a baby who was whining, complaining and crying. They're despicable in their portrayal of this whole thing.”
”The Times-Standard?” asked the interviewer, John Matthews, expressing surprise.
”Rich Somerville in particular,” Glass replied. “Editorial cartoons, editorials and spinning the coverage.” The councilman said it was a “horrible mistake” for Somerville to have been hired as editor of the Times-Standard.
If politicians or other public officials think I'm terrific, I usually wonder what we've been missing. Thus, I take Glass' crack as a compliment, sort of like being on Nixon's “Enemies List.”
But the unsubstantiated characterization of the Times-Standard's coverage of the Arkley-Glass incident -- the equivalent of tossing a hand grenade and running -- is surprising from a person who is described by his friends as straightforward....

You just have to laugh
Only in Humboldt County would they make a federal case out of "the push" - but let the guys accused of tying a woman to a tree for three days and raping her cop a plea... Only in Humboldt County could the DA allow his office to swoop up and dismiss nine felonies in a single day for the son of one of his donors, and not consider that a conflict of interest, but then pull this... But what choice does Gallegos have? This is another instance where his handlers are calling for blood, and he can't deliver.

District Attorney, Paul Gallegos, made public his decision to forward the investigation into the allegations involving Robert Arkley and City Council member, Larry Glass to the California Attorney General’s office stating that “It is important that the Attorney General’s Office review the matter to determine whether the decision on whether to file criminal charges should be made by the Attorney’s General Office instead of ours.” He added further, “I was present that evening, was interviewed as a witness and have had or have a personal relationship with the involved parties and several witnesses. I have some concern that, even if I could decide the matter fairly and impartially without bias for or against any party, any decision I made would have an overwhelming appearance of an impropriety and have communicated that to the Attorney General’s Office. If the Attorney General’s Office determines that, despite the presence of these issues, it is appropriate for my office to decide this matter, I will review it for the possibility of filing criminal charges.”
In a criminal action, a defendant may move to recuse or disqualify the prosecutor on the ground of a conflict of interest that would make it unlikely that the defendant would receive a fair trial. This is done by showing circumstances that demonstrate a “reasonable possibility that the District Attorney’s Office may not exercise its discretionary function in an evenhanded manner”. The defendant must then show that the conflict is “so grave as to render fair treatment of the defendants in all stages of the criminal proceedings unlikely.” The conflict must be caused by factors extraneous to the prosecutor’s official duty. Although both actual and apparent conflicts can form the basis for recusing the prosecution, for a defense motion to recuse the prosecution to be granted, the likelihood that the defendant will not receive a fair trial must be real, not merely apparent.

Editorial: Political bomb ticks on . . .
TS It was hard to know whether to laugh or cry when word came on Monday that the Eureka Police Department was ready to give the district attorney its investigation report on the Rob Arkley-Larry Glass “incident.”
With great anticipation, we looked forward to learning the truth about what happened on Sept. 5 when Eureka City Council member Larry Glass met local mogul Rob Arkley at a reception at Avalon restaurant. Glass charged that Arkley shoved him, said he was having him followed, and threatened to destroy him if Glass voted against his Marina Center project. Arkley's spokespersons have said there was no physical contact or surveillance -- that Arkley was angry over the councilman's attacks on his family. Since there were dozens of potential witnesses at the Avalon, no doubt the police report clarifies who was telling the truth.
But depression set in when District Attorney Paul Gallegos said he would send the report immediately to the state attorney general. Not because he couldn't be fair to both parties, he said, but there was an appearance of conflict because Arkley once contributed to his campaign.
Our tears are because we doubt Attorney General Jerry Brown will want to catch this hot potato.
He has his eye on the governor's seat and is looking for bigger fish to fry . . . er, prosecute. Besides, in responding earlier to Humboldt County Democrats' plea that his office take the case, a Brown assistant wrote that “a mere appearance of conflict is insufficient to warrant recusal.”
So the state seems primed to say “no thanks” and toss it back to Gallegos, the gentleman who -- 560 days and counting after the officer-involved killing of the mentally ill Cheri Lyn Moore -- apparently has decided to let a criminal grand jury make the politically volatile prosecution decision for him. The Arkley-Glass case is a ticking bomb, too. The mind reels in contemplating another 2 1/2-year wait.
So to Mr. Brown or Mr. Gallegos: Please have pity on a poor, suffering community, not to mention the parties involved in the case. Whichever of you gets this case when you're done playing musical chairs, don't drag it out. Tell us if a crime was committed or not. Editorial: Political bomb ticks on . . .

Gallegos has previously told this newspaper that he considers Arkley a friend and that Arkley contributed to one of his political campaigns.
In explaining his reasoning for sending the report to the AGO, Gallegos said, “While I believe I can make a fair and impartial decision, I believe that, due to my relationship with both the parties and some of the anticipated witnesses, it is impossible to do so without creating the appearance of an impropriety.

God help us!
I thought I'd be through posting about Jeffrey "yougofree.com" Schwartz, and that he would quietly return to private life, but no such luck. He's decided to stay in the limelight and opine on the ridiculous "incident at Avalon." His theory seems to be that Arkley wasn't really threatening Glass, he was really threatening the entire City Council by threatening Glass (not allegedly threatening, mind you).
I really couldn't stand to read it all the way through, so if any of you can decipher it, let me know. I kinda had to skim down to where he says: "That's why we need to vet this with local jurors and locally elected judges who care about what the voting public thinks."
Uh, Jeff, judges aren't SUPPOSED to CARE what the voting public thinks. They're supposed to care about this little thing called THE LAW, NO MATTER WHAT the voting public thinks. Read Schwartz's "My Word"

The request was premature...
Despite "Local Solut--" I mean the HCDCC's efforts to get the Attorney General to prosecute Rob Arkley, "heraldo" reports (not in any of the online papers yet) that the AG has declined: “neither the District Attorney nor any involved party has asked us to intervene. Even if such a request were made, it is unlikely we would do so given the considerations set forth in the preceding paragraph. As a general rule, the Attorney General will not intervene in a local matter at the request of a third party, such as the Central Committee”, and continued “any request at this time appears premature. Nothing in your letter suggests that the appropriate local law enforcement agency such as the sheriff’s office or city police are unwilling or unable to investigate the alleged crime. That is an essential first step before it is even appropriate for a prosecutor to consider whether to bring charges.”
Should be interesting to see how Gallegos handles this one. Another rock and a hard place.

Now you know
why Jake Pickering got his ass kicked so bad"" in the last election. If you missed his latest insane "My Word" in The Times-Standard don't despair. His buddy, Richard Salzman is pimping the insane rant through his listserve (this time it's "Redwood Progressive.") If you close your eyes, you can imagine the two of them working on the wording... "Say this.." "oh yeah!, That's Good!" "Now twist the knife, use words like 'felonious' and "spokesliar."
The really twisted part, though, is Pickering is running for yet another office. Jake Pickering is a candidate for the Humboldt County Board of Education.

Dear Larry,
I owe you an apology. Last night was neither the time nor the place for me to bring up how your words and deeds have caused great hurt to my family, specifically my daughters. It was impulsive of me. Unfortunately, when I am impulsive, I tend to be single minded (loud) and empathic (louder). I am counting on you as a father and as a political veteran to understand and accept this apology.
I will not belabor the point that I was trying to make to you last night. As you know, I am more than willing to face the slings and arrows that come my way, especially here in Eureka. It is hard for me to express the pain and outrage that I feel when my wife and daughters are needlessly brought in, as you did. I obviously need to adopt a different and better approach when trying to convey to others why I think that it is unfair that my wife and daughters need to suffer because of this.
Again, my apologies for last night.

I owe you an apology. Last night was neither the time nor the place for me to bring up how your words and deeds have caused great hurt to my family, specifically my daughters. It was impulsive of me. Unfortunately, when I am impulsive, I tend to be single minded (loud) and empathic (louder). I am counting on you as a father and as a political veteran to understand and accept this apology.
I will not belabor the point that I was trying to make to you last night. As you know, I am more than willing to face the slings and arrows that come my way, especially here in Eureka. It is hard for me to express the pain and outrage that I feel when my wife and daughters are needlessly brought in, as you did. I obviously need to adopt a different and better approach when trying to convey to others why I think that it is unfair that my wife and daughters need to suffer because of this.
Again, my apologies for last night.

Behind the scenes
Ask any politician or aspiring politician in this county if they are working with Richard Salzman and they will deny it.
But he continues to work behind the scenes, continuing to stir up trouble and smear his opponents. He got caught sticking his little anti-Arkleyville stickers on parking meters in Eureka, got caught mailing out "Dump Geist" bumper stickers - sneaky attacks and dirty tricks characterize his political dealings.
He is now avowedly anti-Arkley, where once he went begging for money for his candidates.
Is there anyone who believes he is not involved in the Glass/Arkley affair?

Under Richard's list he is inviting people to make comments on the Glass/Arkley story in the Times Standard today,
Under the AEB listserve he is supporting Pat Higgins and continuing to beat the drum against Palco.
Larry Glass is citing the boilerplate "privacy disclaimer" as a reason for his not releasing the apology he received from Rob Arkley.

Before the facts are in w/update
The Humboldt Democratic Central Committee is a political animal in more ways than one. And this week, in their partisan zeal, they decided to send a letter to the Attorney General demanding he look into "the push."
HCDCC Subcommittee on Education and Communications Chairperson Greg Conners said the group’s hope is that the attorney general will investigate “and the appropriate action will be taken based upon facts that can be confirmed.”
"based upon facts that can be confirmed" - Fascinating statement. Because nothing has been "confirmed" yet. First Glass filed a report, then he decided to press charges. Then EPD appointed a senior homicide detective to look into the matter, and presumably an investigation is underway.
Before the results of that investigation are known, the HCDCC pounces. Seizes this golden opportunity to bring down the man that brought down Tom Daschle. And, depending on Jerry Brown's own integrity, he may seize this opportunity to punish a politcal foe of the democrats.
And, When reached by phone on Thursday, Gallegos said Arkley has contributed to his campaign and he considers him a “friend.”
“To avoid an appearance of an impropriety, I think it’s best the AG’s Office as opposed to me” pursue the matter, he said.
Meanwhile - the Attorney General's Office has tacitly refused to get involved here with Paul Gallegos, deeming all criticism of him to be strictly "political." But the stack of complaints will add up sooner or later, and the decimation will reach a point where the Attorney General has no choice but to intervene, maybe even have to send in a team to run the office until it can be stabilized.
Yet the HCDCC cares naught. CAST, the Victim Witness Unit, an unbelievable list of plea bargains, a Grand Jury report that left no doubt as to what was happening, yet the HCDCC chose to endorse the man. Even though, in that case, the facts were in.
It's very telling.

I'd have to say things are going to get even more interesting. The Journal's Town Dandy reports: We had a good time meeting last week with Steven Glazer, the public relations man retained by Eureka kazillionaire Rob Arkley to put forth his case in the now-infamous Avalon incident (see "Town Dandy," Sept. 13). We'd heard from KSLG's John Matthews -- the first local to score an interview with Glazer, we believe -- that the fellow actually serves as mayor of the East Bay town of Orinda when not flacking. That intrigued us. Then, when Glazer showed up and we embarked on the customary getting-to-know-you chat, we were even more astonished to learn that in the turbulent ’70s he had served as press secretary to then-Gov. Jerry Brown and embattled California Supreme Court Justice Rose Bird.
But Glazer was in town to talk Arkley, and we worked our way quickly to the point. Eureka City Councilmember Larry Glass, the alleged recipient of Arkley's shoves and "I will destroy you" threats, had gotten all the good press so far, Glazer said -- he realized that. Now the Arkley family wished to tell its side of the story, so they retained his services. He had already worked with them in some unspecified capacity on the Marina Center, the big box-anchored development proposal that will be making its way before the City Council sometime soon.
Basically, Glazer wished to make the case that Glass was an asshole from way back, especially to Arkley's daughters. Though he could not discuss what happened that night at Avalon, he could say that this alleged rudeness to the Arkley daughters was what so exercised the father that night, when he met Glass face-to-face for the first time. He provided a statement from one of the daughters, to the effect that in their meeting with Glass, back when he was giving away "anti-Arkleyville" stickers in his shop, Glass had called the daughters "collateral damage" in his war with Arkley. (Glass told the Times-Standard that he didn't remember the conversation that way at all.)
Fine and good, we said, but it doesn't really cut to the heart of the matter, does it? The accusation on the table is that Glazer's client physically assaulted and verbally threatened an elected official. What of that?
Glazer said that Arkley had apologized for the incident, contra Glass' assertions. He then read a section of an e-mail that Arkley sent to Glass the morning after. Strangely, though, he would not give me a copy of that apology. He said that I should get it from Glass -- that it was Glass' place to give it to me. It was then I realized that I was in the spell of some kind of master PR mojo that I didn't really understand. To me, it was like -- Dude, you have information? Great. But I don't really feel a burning desire to play Blue's Clues with you.
But then the City of Eureka released the e-mail in question in response to a Public Records Act request from the Times-Standard. We were able to horn in on their work. You probably read the full e-mail in Wednesday's T-S. Suffice it to say that it did, in fact, say "[M]y apologies for last night." The e-mail also reiterated that from Arkley's point of view, it was all about the hurt to his family: "It is hard for me to express the pain and outrage that I feel when my wife and daughters are needlessly brought in, as you did."
For Glass, it wasn't enough. "'I'm sorry I pushed you, I'm sorry I dissed you, I'm sorry I called you a liar a million times,'" he said Tuesday. "None of those elements were there."

Glass requests formal criminal investigation into alleged confrontation with Arkley
Looks to me like Larry has succumbed to the pressure, demanding he "get Arkley." You can see the tone change and the rhetoric escalate on heraldo's anti-Arkley blog. It went from Glass filing an incident report just to get it on the record to now it's his "civic duty" to file charges

I guess we'll end up talking about it here since, among other things, Larry Glass said, "that he tried and failed to bypass the EPD and take his case directly to the Humboldt County District Attorney’s Office."
Interesting in and of itself, given the Salzman connection to both men.
Then there's the fact that this is yet another case of conflict of interest for Gallegos, since Rob Arkley was a big supporter at one time. $17.000. But nothing this last election, which seems to be a root cause of all the anti-Arkley venom. There were no complaints about the guy until his rift with Salzman.
I guess I'll add it to the "cases to watch" label.

It gets weirder - heraldo has it, and Eric has it, Greg and Carol have it, of course - The ludicrous HCDCC has sent a letter to the Attorney General demanding that the AG look into the Arkley/Glass affair. Funny they have no such scruples about CAST, the loss of our experienced prosecutors, Derek Bowman, Cheri Moore - Gallegos is their baby. Disgusting.

I have just two words to say to Larry Glass: Cry Baby!
This is just the silliest thing I have heard since my boys were 8 and 6 years old. “He pushed me and I almost fell.” “He called me a doo-doo head.” “He said it first.” “Well, he said that he would break my bike.” “I'm gonna tell on you.”
To Larry Glass and Rob Arkley: Grow up the both of you, or you will lose your allowance for a month.
