EPIC gets a seat on the Planning Commission

Mark Lovelace proves, once again, the necessity of staying awake, engaged and vigilant.

Lovelace Makes New Appointment to Planning Commission - Ryan Burns

...Whatever the reason, (Ralph) Faust, who was just reappointed to the Planning Commission’s Third District seat last year, chose to step down this week. Third District Supervisor Mark Lovelace chose as his replacement Noah Levy, an Arcata resident and program director for the SoHum nonprofit Sanctuary Forest.

Levy is also on the board of the nonprofit Environmental Protection Information Center (EPIC)...

Well, we can safely say we all learned something

It’s clear now that many of the 626 “Likes” registered to the “Elan Firpo for DA” Facebook page are stone cold fakes — bogus support from people based in such far flung locales as Bangladesh, Tanzania and Cuba.

But how do you even figure that out?

Ahh, the intrepid reporter knows the answer, revealed in the thread at the link (So, listen up candidates, you only think your stance on issues matters, It doesn't. Your Facebook page does. So, forget all that law school stuff, and go to Facebook school, you'll be glad you did):

Hi Ryan,
O.k, I'm looking at the Firpo for DA Facebook page, but I don't see where I can browse all the individual likes. I can only see the few "likers" who also happen to be my own Facebook "friends" as well. Same with the Lost Coast Outpost's Facebook page, which has 15,706 "likes" listed. But I'm not seeing where I can click to see the list of them. Can you please explain how I could access the full list of "likers" on a Facebook page? Thanks.
Ryan Burns Mod Clickey McLikefarmer
Sure: Go to the "search" bar at the top of your Facebook page. There you can type in "people who like Elan Firpo for DA," or "people who like Lost Coast Outpost." That should bring up a complete list. You can also cross-reference by searching for, say, "People who like Elan Firpo for DA and live in London, United Kingdom."

Thanks!

If you're going to comment on this thread - how about laying out what IS important in this race. What are the issues. Help the fella out.

'Professor' Gallegos didn't get half this much scrutiny as he ran the office into the ground.

When things 'fall through the cracks' at the DA's office - some guy is out on a Cruz waiver. Some guy gets out and goes right back to committing crimes, and people get hurt. People die. Do you get that?

The way it is now, it is impossible for the Deputy DAs - the PROSECUTORS - to do their jobs. There aren't enough of them left. They get handed cases and told to go into the court room without any chance of getting to know the facts and the issues, and the players in the case. You couldn't work under those conditions. You might put your head down and try to do your best, but you'd know, it's not possible.

How do you do a sit down interview with the guy and not finally ask the tough questions? He does have a year to continue messing things up, you know.

Isn't it nice to know that Ryan Burns really understands the IMPORTANT issues relating to the DA's race. UPDATED

There's not even a question mark, because, of course, the answer is NO.

Because we ALL know that what' really important is what the candidate does on Facebook, right?

And it's not like Élan Firpo isn't involved in two - TWO - murder trials right now. In an office that is running at half staff - how did it get that way, Ryan? Where are the seasoned prosecutors, Ryan?

Firpo facebook likes brouhaha much ado about nothing - John Chiv/Words Worth

Who Flooded Firpo’s Facebook Page with Fake Friends? - Ryan Burns again/Lost Coast Outpost

It’s clear now that many of the 626 “Likes” registered to the “Elan Firpo for DA” Facebook page are stone cold fakes — bogus support from people based in such far flung locales as Bangladesh, Tanzania and Cuba.

The big mystery that remains is who’s responsible — a supporter looking to position Firpo as the early frontrunner? Or an opponent looking to paint her as a dirty campaigner?...

We’ve spoken with Firpo and campaign worker/personal friend Jaison Chiand a number of times since this came to our attention. Initially, they both expressed confusion about the Bangladesh connection and, after digging through several hundred supporters, said they couldn’t find any from outside the country.

This morning we walked them through a process to bring up the entire list of supporters, which turns up some truly suspicious accounts....

Asked if he had any idea who could be responsible he said, “I don’t even know how it happened, let alone who might have done it.” After a pause he admitted, “I have ideas but I’m certainly not going to make accusations.”

Firpo said that she doubted it was anyone involved in her campaign, including Richard Salzman. But neither could she definitively rule that out. Regardless, she said her intention is to get the Facebook page cleaned up and move forward with her campaign.

Élan's campaign responds (h/t: John)
As for Facebook “Likes”, I don’t know who did what or why, but we have a bunch of people from foreign countries in there that appear to be fakes. We are working to remove them, but it is a tedious process.

As our real followers know, we would love to boost our “LIKES”. The purpose of which is to have as many people engaged and learning about Elan as possible. Hopefully as people learn more, they will like what they see, and that will turn into votes. There aren’t many votes for us in Bangledesh. Encourage people to get their information from Elan herself.

I’d encourage everyone to come out to one her events and meet her for yourself. Believe it or not, the other campaigns and anonymous bloggers who represent them don’t paint an accurate picture.

She is currently in Freshwater at PORAC and then on to Fortuna. Tomorrow, she will be in Hoopa.

Updated: Judge Feeney keeps gag order in effect until amendment filed and Intervention hearing held in Bullock case

The gag order is going to be refined - John Chiv/Words Worth

...Judge Feeney said, "This is a very important issue" and when Cockrum added that the D.A's office agreed to some kind of gag order but not the same order he had filed, the Judge repeated his statement on the original order being beyond the scope of the motion, asked Cockrum to file a proposed amendment order, see if all parties could agree. He also asked Cockrum to provide written case law for the additional changes he was asking to the original order.

If all parties could not agree on a proposed amendment, then there would be a hearing. Until that time, the gag order is in effect.

Defense is requesting a gag order in the Bullock case. UPDATED

John Chiv/Words Worth

That's unfortunate.

Ruling on motions in Bullock case-Bail denied - John Chiv/Words Worth

Both motions granted. Hon. Judge Dale Reinholtsen presided over the hearing today. The motion for the gag order was tentatively granted but is reset to be heard before Judge John Feeney on January 15 to define the parameters of the order.

County Counsel was present at the hearing regarding the protective order on publicity. County Counsel wanted clarification on the protective order and their concern was how that would limit the County's ability to respond to public record requests. Judge Reinholtsen had considered how the gag order would affect media so in order to research and make an informed ruling regarding the County (The County just showed up for this hearing after being served the order by defense) Reinholtsen "tenatively" granted the order. The final ruling is expected when Judge Feeney hears the case next week.

Regarding the motion to increase bail or deny bail, Judge Reinholtsen denied bail... More at the link.

Bullock held without bail, defense granted gag order - KIEM-TV Channel 3

Deputy District Attorney, Elan Firpo, filed a motion and asked that Gary Lee Bullock, 44 be held at no bail. On Monday Bullock’s bail was set at $1.2 million at his arraignment. Bullock has been at the Humboldt County Jail since Jan. 2, after his stepfather turned him into authorities. Bullock is accused of killing St. Bernard Catholic Church Priest Eric Freed with a wooden stake and metal pipe after breaking through a window to Freed’s home on New Year’s Day.

...Regarding the motion to increase bail or deny bail, Judge Reinholtsen denied bail.

Prior to his decision, he heard from both lawyers. Bullock's attorney Kaleb Cockrum argued that Bullock had ties to the community because his wife and family are here and that raising bail was "beyond (Bullock's) assets".

Elan Firpo who is prosecuting the case countered Cockrum's claim ...Bullock's wife is leaving the area because of this case and that own his family wants nothing to do with Bullock. She said he has means to raise bail and that he was a flight risk....More at the link.

Hauling homeless into court a waste - Arnie Klein/My Word Times-Standard

...There were many different options that could have been explored, such as homeless court, a diversionary program, or penal code 849, which basically states “deemed not arrested and released.'' In other words, he could been held in jail over night and released in the morning. If the prosecutorial authorities felt that this homeless man had to be prosecuted, they could have filed the case as an infraction, which would have resulted in a court trial that did not necessitate the presence of a jury and a defense attorney....

Bullock faces three counts: Murder with special allegations of torture and of first degree burglary; vehicle theft; and attempted arson. Bail set at $1.2 million.

Bullock pleads not guilty in priest's death - The Times-Standard

Gary Lee Bullock, who turned 44 today, faces charges of murder with special allegations of torture and of commission of first degree burglary. Bullock is also charged with vehicle theft and attempted arson. His bail was set at $1.2 million.

Bullock was arrested Thursday near his family's Briceland home after a sheriff's sergeant contact his mother. Bullock's stepfather drove him down the road of the rural home, where they were met by sheriff's deputies who conducted a traffic stop. Officials said Bullock did not know his family was surrendering him to authorities.

Bullock Pleads Not Guilty in Priest Slaying Case - Ryan Burns/Lost Coast Outpost

With baggy eyes and a downturned mouth, Bullock showed no emotion as Judge John T. Feeney read the list of charges, which includes first degree murder, vehicle theft and attempted arson. The murder charge includes two special allegations — first, that it was committed in commission of first-degree burglary and, second, that the murder was intentional and involved torture.

The next court date is January 15th.

Rev. Freed’s Slaying and the Deadly Probation Fail

One Small Detail Not Mentioned: Suspect Was on Probation and Shouldn’t Have Been Released From Jail - Skippy Massey/Humboldt Sentinel

...After being brought to the jail on a new offense, Gary Lee Bullock, the alleged suspect in Rev. Freed’s slaying, was released on his OR (own recognizance) only a few hours before Freed’s murder. Unbelievably, EPD was called back and contacted him again a second time due to his erratic behavior. Bullock was merely referred to the Rescue Mission at that time.

One of the rarely mentioned points to consider is this: Mr. Bullock was placed on a three-year probation term
back in April for cocaine possession. Along with that grant of probation came a set of terms which Bullock agreed to for obeying all laws of the community– or he’d be back in jail.

When originally brought to the jail he should have been retained on a ‘Probation Hold’ until the Humboldt County Probation Department or District Attorney’s Office—who had the jurisdiction in the matter– properly assessed his situation. That didn’t occur....

Bullock’s probation status and lack of supervision hasn’t been brought up nor
is it widely known to the public. It warrants investigation because other incidents, similar in nature, have been occurring routinely. In fact, it is quietly happening all too often following our review of several hundred crime reports over the past two years.

Think Jason Warren’s alleged brutal murder of Dorothy Ulrich and the subsequent hit and run of the Bayside joggers. In that instance, Warren, already sentenced to State Prison, never should have been released from the jail to freely engage in his murderous rampage upon others.

We wonder if things would have turned out differently if the ‘probation hold’ process that was in place and should have occurred actually happened, and to what degree it did in both cases....

Discussion on Facebook points out some misconceptions: this... doesn't cover the jail overcrowding due to AB109. The jail can't keep people for disorderly conduct, which is a misdemeanor.

Which is true - in this whole thing, there's a lot of discussion about letting him go, but in fact, you can't keep holding someone who was only picked up for being 'drunk in public.' There's plenty of questions about letting him out in the middle of the night when nothing is open, and he has no means of transportation back to his own home - and that's certainly a policy that ought to be considered.

But here's the deal - Bullock was charged with cocaine possession, but plead to a Misdemeanor - before this incident. Cocaine is a felony, no? So they chopped it down to some Misdo. Had he been on Felony probation, there would have been a stronger chance that the jail could have and maybe would have kept him in.

It's another plea deal with tragic consequences. Deadly consequences.

According to Lt. Steve Knight of the Humboldt County Sheriff’s Department, the caretaker of the Sacred Heart Catholic Church on Myrtle was confronted by an intruder today inside the building today around 2 P.M. The woman stopped by to check on the grounds and spotted a bicycle inside the building.

She opened the door and went into the dark interior. A man, approximately 6 foot tall wearing dark clothing including a sweatshirt and a beanie or a hat, began to move towards her. She retreated behind another door and called 911. She was not injured or confronted further. The man fled left the scene and has not been found.

Lt. Knight said that there was nothing to indicate a connection with the murder of Fr. Eric Freed but neither is his office ruling out the possibility. Deputies have been asked to keep an eye on all churches at this time—”especially,” Knight said, the “Catholic churches.”
