Yeah. You know, it's too bad they found that section talking about govt. 'discouraging' women from having babies tucked in to the dang plan. (because. Global. Warming. Or Something.) If that hadn't happened they never would have known that they better go over it with a fine-toothed comb.

Can't blame them for being worried about all those oh-so-politically-correct Orwellian terms, though. I mean, none of us want to end up living 1984, do we, Dave? Not even you. Or maybe, especially you.

The Shove redux... UPDATED: Frustrations between Humboldt County Supervisors boil over; Lovelace apologizes for 'slap on the back' And, UPDATED AGAIN.

But it became a very big deal - the HCDCC Subcommittee on Education and Communications Chairperson Greg Conners said the group’s hope is that the attorney general will investigate “and the appropriate action will be taken based upon facts that can be confirmed.”

Remember all that?

So....

My basic policy has always been - things have to be verifiable. And accurate. My general rule is three sources, or I won't post it.

I'm not the only one who's going to be asking questions, and it appears there are a number of people who can answer the questions at hand. Tomorrow's Monday. We'll see.

Basically, Humboldt County is a small town, and people talk to each other.

CSAC "a conference of California county officials"

What's in question? A comment posted on at least two other blogs talking about an altercation (incident, may be a better word) - a physical altercation - between two Humboldt County Supervisors at CSAC, witnessed by at least one other Humboldt County Supervisor, and one Del Norte County Supervisor. Questions whether charges were filed, whether the Humboldt County DA would act.

That last part makes me laugh. Are you kidding?

OK, so my stance on the Larry Glass thing was he should have accepted the apology, sucked it up and moved on, file a report if you like to get it on the record if you're really worried that there may be a repeat incident, but move on. But that's not what happened. So it will be interesting to see the how the cheerleaders in that 'push' respond here.

Third District Supervisor Mark Lovelace apologized Monday for letting his frustrations boil over at a California State Association of Counties meeting last week, leading to an incident that one Del Norte official called “disturbing” and “inappropriate.”

The incident occurred last Wednesday, during a meeting of the Coastal Counties Regional Association at CSAC's annual conference in San Jose, which was attended by four Humboldt County supervisors. During the meeting, the association -- which Lovelace has co-chaired for several years -- voted to appoint 4th District Supervisor Virginia Bass as its new co-chair.

Lovelace apparently felt frustrated and slighted at the appointment, and approached Bass and 1st District Supervisor Rex Bohn after the meeting, giving them what he described as a “perhaps an exaggerated, good-old-boy slap on the back.”

Reached Monday, Bass described the contact as “an extremely exaggerated slap on the back.”

She said she didn't really want to get into details, but the incident has been mischaracterized by local blogs.

”What you're reading on the blogs is an exaggeration,” she said. “Nobody hit the ground. Nobody shoved back. There was some frustration.”

Local blogs? Not exactly. Local blogs responded to posted comments by removing them. Those who have comment moderation enabled declined to post them. I would posit that Hank at Lost Coast Outpost took it down because he considered it inflammatory and would likely look into the allegations. Only this one posted anything about it - and you'll note no exaggeration above. We're a very responsible bunch, us bloggers. And PART of being responsible INCLUDES posting stuff like this when it comes up. Like it or not. Frankly, that was just as true as all the newspapers reporting about "The Push" and about "The Speech" more recently.

Mark apologizes to Virginia and Rex - John Chiv/Words Worth 12/3

...In addition to his personal apology in private, Mark said that while trying to explain his frustrations, some of his remarks came across as justifying his actions. There is never any justification, he said, for such behavior. Mark added that in the last week he had seen his actions through the eyes of others.

He concluded by saying that he hoped both Virginia and Rex and the community would forgive him and he promised that "it won't happen again."

Rex was quiet. Virginia did respond. She said she appreciated the apology, especially to the community. She commented that kids are taught not to use violence and as role models and elected officials, "we are held to higher standards." She pointed out that if this behavior was by an employee, there would have been an investigation, perhaps even a dismissal. Virginia concluded her remarks by saying "that this was not the time to talk about it" but that she looked forward to a discussion perhaps in the future and suggested anger management to Mark.... Having thought about it: Since being elected, Mark has taken people off of commissions and boards. Like Charles Ollivier from the railroad board. Should Charles, or any of the others, have been angry at Mark? And if they were angry, which is understandable, even in Mark's own case, what would have happened if they had hit Mark? Or anyone else involved in the decision.

We know the response to the Dan Johnson speech/plagiarism issue. Calls for his head. From some of the same people - cough - SYLVIA DE ROOY - cough - who bend themselves into pretzels to excuse this one and declare it a 'right wing' thing. Excuse me?

I said in the beginning that what was especially interesting in this case was going to be watching those who screamed for the AG in Glass's case remain silent in this case - and so far, at least, that has been the case.

Humboldt County Supervisor Lovelace apologizes to Bass, Bohn: 'I promise you, it won't happen again' - Catherine Wong/The Times-Standard

Humboldt County 3rd District Supervisor Mark Lovelace apologized Tuesday at the Board of Supervisors meeting for the “slap on the back” he gave to supervisors Rex Bohn and Virginia Bass at the annual California State Association of Counties conference.

”Some of what I said was trying to explain my frustration, and I think that came across as trying to justify my actions, which I can't,” Lovelace said. “No matter what might have transpired beforehand, there is only one person that is responsible for my own actions, and that's me.”

...”All I can do is apologize and accept the consequences of my actions and hope that the two of you, the rest of you, and the community might forgive me for treating you both so disrespectfully and for seriously overstepping personal boundaries,” he said.

Bass, who represents the 4th District, responded by saying that she appreciates the apology, especially to the community. She noted that there would be an investigation -- and possibly a dismissal -- if a similar incident happened with county staff.

”We're elected, so we have different paths, so I think the apology is certainly along that path,” she said, adding “perhaps this isn't the time to talk about it, but I would be interested in further discussion in some anger management.”

Did any of our local political orgs - Paykeeper, Humboldt Watershed Council, The so-called Alliance For Ethical Business, Healthy Humboldt, ERF, and others - have to answer questions like these asked by the IRS of 'conservative' groups:

List each past or present board member, officer, key employee and members of their families who:
a) Has served on the board of another organization. Has previously conducted similar activities for another entity.
b) Was, is or plans to be a candidate for public office. Indicate the nature of each candidacy.
c) Has previously conducted similar activities for another entity.
(Like Humboldt Watershed Council/Healthy Humboldt?)(Like Local Solutions, Alliance for Ethical Business, Redwood Progressive, CREG, DUHC, Friends Of Paul Gallegos, Our Humboldt, Behind the Redwood Curtain, Curtain FOPG-Listserv

Public events are also under scrutiny with the IRS demanding to know the time, location and content schedule of each event.

Copies of any and all handouts must be included.

Names and credentials of all instructors and copies of any workshop materials used.
All speakers must be identified and copies of every speech must be included.


AND THERE'S MORE: “Have you attempted or will you attempt to influence the outcome of specific legislation? If so, provide the following … all communications, pamphlets, advertisements, and other materials.”

“Have you conducted or will you conduct candidate forums? If so, provide the following details… The issues that were discussed. Copies of all handouts provided.”

“The names of persons from your organization and the amount of time they will spend on the event. Indicate the name and amount of compensation that will be paid to each person.”

“All copies of your corporate minutes from inception.”

“Please identify your volunteers.”

“The names of donors, contributors, and grantors.”

“Do you encourage eligible voters to educate themselves, register to vote, and vote? Explain in detail how you do this.”

“You were formed 12/28/10. Provide actual financial information for 2010 & 2011, and a budget for 2012. Provide details regarding each item listed.”

This level of inquiry goes well beyond the scope of the Form 1023 application for exempt status - and appears to be applied to one side and not the other.

In particular, we know that Humboldt Watershed Council and The AEB ran ads here locally, oh so many years ago. The AEB never showed up on any of my searches of IRS databases. Humboldt Watershed Council, on the other hand has a substantial record on Guidestar, and in the early days, at least, showed their 'educational' requirement was fulfilled.

It's quite a racket.

And, more than that, it's pretty disturbing when the full power of the federal Government/IRS is brought to bear on one side and not the other. There are thousands and thousands, if not hundreds of thousands of 'left-wing' orgs, we know they are formed and used and discarded just like boiler room stock scammers. Michael Shellenberger himself had quite a list, including Apollo Alliance, "The Rose Foundation," "The Committee of Concerned Maxxam Shareholders," "As You Sow Foundation" - No small potatoes there.

Funny how there was never any teeth-gnashing about Lovelace's crew marching in lockstep - and, the push to make the BOS, in one day, with virtually no notice, and little public input, strip every property owner of their rights, collateral damage in the zeal to kill Palco.

And, btw - there's a comment at the Journal site by 'Rose' - a nasty comment directed at Steven Lewis. It's not me, but I bet I could tag who it is. And it's pretty childish to keep using my name.

What Mark hath wrought

What Mark Lovelace set in motion all those years ago has now come full circle - and irony of him now sitting on the Board of Supervisors to witness the fruit of his machinations - and for him to bemoan someone as being 'divisive' and 'having an agenda' is truly amazing to behold.

On that fateful day, with virtually no notice, the Board of Supervisors voted to strip every citizen's property rights. Egged on by Lovelace (the anti-Palco activist, not yet a Supervisor), and his astroturfing cadre of speakers, lined up with their 3-minute share of the talking points, lauding the Board for their 'courage' in trying to slam the door on Pacific Lumber Company yet again, the Board's decision had far reaching effects, and woke the mythical sleeping giant.

The end result - a coming together of a very diverse group of people, landowners, people who cared about their property rights. Southern Humboldters, old folks, hipsters, back-to-the-landers, builders, and more. Their vow? Never again. Recognition that vigilance is the price of freedom, and Lovelace's reign came to an end.

His vision was well on its way to taking over. Now, the nail is in its coffin.

I'd say "May It Rest In Peace" but that would be too kind.

Lee Ulansey emerged as an articulate, forceful, and determined spokesman, championing the rights of all the property owners in the county. He's now been through the fire, vilified at every turn by the "progressive" machine. Like anyone who stands against them, he's been accused of being paid for, being in collusion, and more. They've never known what to make of someone like him.

Congratulations, Lee. And, to the new Board who made the decision.

Give Faust a run for his money.

And, let's hope that what the Board did, way back in 2007, never happens again.

Cannabis Grow Damage Like ‘Worst Of Timber Industry’ - Daniel Mintz for The Arcata Eye

A five-county program assessing impacts on salmonids has named unpermitted grading as a major impact and one county supervisor said the effects of illegal grading connected to marijuana grows are as bad as those seen during the dark years of the timber industry.

Supervisor Mark Lovelace, who was one of the county’s most active environmentalists before being elected, made those comments as a result of a new regional study on habitat protection policies presented at the Jan. 10 Board of Supervisors meeting.

Dr. Richard Harris, the researcher who coordinated the study, said unregulated and illegal grading – including the grading that enables marijuana grows – is a problem. And Lovelace described its scale as massive in Humboldt County.

“It’s phenomenal,” he said, referring to photographs of grow-related grading that he’s seen. “And it’s shocking – and it compares with the worst of the worst from some of the bad years of the timber industry....” Read the rest

Actually - some have said - for years - that it has always been worse than the timber industry, and has gotten even worse in recent years since pot growing has become defacto legal in this county.

Step aside, the REAL activist muscle is involved now

Armed with a variety of fliers, sign-up sheets and a microphone, Aryay Kalaki and Jerry Martien -- event organizers for the newly formed Occupy Humboldt County -- spoke about the need to move the “Occupy” movement beyond the courthouse's doorstep.

”The attempt here is to find a transition from the (Occupy Eureka) group here to finding a way to be effective in doing outreach to the larger community,” Kalaki said.
Whaddya wanna bet there are some other well-known names in the shadows.
”I'm hoping the movement can help to be a voice for real change on big issues,” (Mark) Lovelace said. “I need these people to help me advocate at the state and national levels.”
Higher office?

So far - what have they accomplished? They've got a cyclone fence keeping EVERYONE off the lawn. Good going. Ruin it for everyone, that is the end result of #Occupy. Eyesores, less freedom and more restriction.

Renege on student loans - no more student loans for anyone. Ruined for everyone.

Default on your mortgage to bring down the banks? No more mortgages for anyone. Ruined for everyone.

That's your end result. Nice to know who's down with that.

”Mark stabbed us in the back”

...The board decided to discuss and vote on each candidate in succession, and unanimously voted to send the names of all the candidates, except Lovelace and Farley.

A majority of the few members of the public who spoke -- there were fewer than 10 people in attendance -- opposed sending Lovelace's name and spoke of Bass's consensus building skills, Zanzi's experience with the California Department Fish and Game and Farley's experience on the Ferndale Planning Commission. The board was even told of two petitions, totaling roughly 900 signatures, in opposition to Lovelace, gathered within 24 hours.

”I believe that he (Lovelace) is divisive and he is out of touch with the county,” said Bob Morris, with Humboldt Coalition for Property Rights (CPR)....
Remember - As part of the the scorched earth pursuit of an agenda, Lovelace is the man who hounded and badgered Tom Herman and Roger Rodoni - and hounded and badgered John Campbell to his death.

It remains unknown whether he is behind the Humboldt Herald, though many suspect he is. If he is, then his pursuit of political opponents goes on. If he isn't behind it, and knows who it is, he allows it to go on.

Divisive doesn't even begin to cover it.

And remember: The criticism about Mark needing to attend to needs of his district are fair - he needs to look no further than "community development services" (The Planning Department) and the mess they have made of the general plan process - Last May, he set a time frame, supported by the BOS to bring the completed General Plan to the Board of Supervisors by October of last year, and yet still another six months has passed with no word from Kirk Girard, and communities are becoming increasingly agitated.

Forget the Coastal Commission - clean up the County's house.

Richardson Grove protesters arrested for disrupting supervisors' meeting

When board Chairman and 3rd District Supervisor Mark Lovelace asked for public comment on the board's consent calendar during the meeting, several people got up from their seats and began singing, “No road widening through Richardson Grove” and, “We are the people and the people say, 'No....' ”The protesters, who oppose the U.S. Highway 101 road realignment project, sat in a circle in the middle of the room and held hands as they sang. They wore matching T-shirts with the phrases “RICHARDSON GROVE ACTION NOW 7076027551” and “NO ROAD WIDENING, CANCEL THE PLAN!” printed on them.... Deputies once again cleared the room. A Times-Standard reporter and a photographer attempted to remain in the chambers to observe sheriff's deputies' interactions with the protesters, but were told to leave.... They refused and were disruptive. After about 20 minutes, several protesters were removed from the room in wheelchairs by deputies. Some walked out. The protesters, their hands cuffed, continued singing as they were wheeled and escorted from the chambers.

Godsey said Tuesday afternoon that Kim Starr, 39, of Eureka; Gavin Wise, 34, of Eureka; Peter Camacho, 25, of Eureka; Jason Proulx, 30, of Trinidad; Emily Gimeno, 31, of Eureka; and Jeff Musgrave, 32, of Trinidad, would be released on their own recognizance.


C'mon, this whole thing has turned into a ridiculous circus. It is kinda funny that Mark is having to deal with it though. Maybe he can have a chat with his friend Ken.

... “Why is he rushing to make these appointments? That’s the question on everyone’s mind,” said Susan Jordan of the Coastal Protection Network. “He called for the list (for the Central Coast) in October, well before there was even an opening.”

The governor’s move has raised eyebrows, in part because he is making the appointments himself rather than allowing his successor to do it and because Schwarzenegger, viewed in the Capitol as seeking to polish his environmental legacy, wants to exert some measure of control over the powerful commission as he departs office.

“It was curious why he would act before the new governor came in. It usually is considered protocol that the new governor make the appointments,” Jordan added....


As for the local situation... Lovelace and Neely overreached. Again.

Paul Hagen kicks off campaign for Humboldt County district attorney; challenger aims to 'protect Humboldt's future'
Flanked by members of the environmental community, Paul Hagen officially kicked off his campaign for Humboldt County district attorney at a press conference Friday, promising to bring the values of fairness, justice, community and safety to the office.
”As your district attorney, I will give the very best of my life's energies to serving the people,” Hagen said. “The end result is that I will deliver fair application of our laws, and I will deliver effective, even-handed justice.”...

Hagen, who touted his experience working under seven different district attorneys and forming cross-jurisdictional task forces, was introduced at the conference by 3rd District Humboldt County Supervisor Mark Lovelace, Arcata City Councilman Mark Wheetley and Cheryl Seidner, a Wiyot tribal leader who worked with Hagen on the Humboldt Bay Center for Sustainable Living....

Mr. Infill and the DA

Supervisors back felony charge for Titlow Hill subdivisions
...Bareilles reportedly illegally subdivided his rural property, the former Double B Ranch in the Titlow Hill area, about 20 years ago. The county, which said it only came across the full extent of the activity recently after investigating a complaint, has since collected taxes on those parcels.

Third District Supervisor Mark Lovelace said after the hearing that the probation report was not what the county was concerned about -- the county would recommend a felony regardless, based on what's happened over the last 20 years on the property. The county's letter outlined the impact Bareilles' reported actions have caused to the environment, those living in the area and to county operations.

Lovelace said Bareilles' testimony did not sway him.

”Everything he said only confirms what the board put in the letter,” he said. “He only wants a solution that basically gives him everything that he wants.”

The District Attorney's Office offered Bareilles a plea bargain that would have involved Bareilles making a contribution of $283,000 to be deposited into a trust for the county to use to fix the violations, Lovelace said.

Bareilles has yet to agree to the deal, Deputy District Attorney Christa McKimmy said.

This article is wrong on a lot of points, for example, the amount in the article was $238,000.00. But at the hearing yesterday, which I attended, the amount was $283,000.00. Fact check much?

Also, at the time Bareilles entered the guilty plea, it was conditional that he be allowed to put on evidence and argue for it to be tried as a misdemeanor rather than a felony. That was a part of the plea. This article implies he changed his tune at a later date.

The article also doesn't mention that Bareilles applied for and received approval by the Board of Supervisors for a large subdivision in the area back in the 1970's and early 1980's. The Board said yes, Bareilles did all the work and then, with Bareilles more than one million in debt at the time of completing the subdivision, the Board changed their mind and denied the subdivision.

Full disclosure, this is my father.

4-1 vote - railroad DOA

Why waste anyone's time or money with a railroad authority? It is, for all intents and purposes, dead. And Neely, Lovelace and Clendenen ought to be upfront about their intentions. My opinion.

Save the County alot of money, close the port and shut down anything to do with the railroad, The shut-it-down crowd is on power and nothing will stop them now.

You voted for them. You got it.

Question: Who else applied? Where does Linda Atkins stand on the railroad? With the shut-it-down crowd? And if so, WHY would you appoint someone who may have no intention of seeing things work out for the railroad? Is it the intention of the Board of Supervisors to sabotage any efforts to make PROGRESS with the railroad efforts?

The Humboldt County Board of Supervisors is poised tomorrow to deliver yet another slap to the cadre of railroad dreamers who have been hoping against hope, year after year, to restore freight service along the 10-years-dead Northwestern Pacific Railroad line and so develop the similarly stagnant Humboldt Bay into some kind of entrepot in Pacific Rim international trade.

On the agenda for tomorrow’s Board of Supervisors’ meeting is an item that would appoint new Eureka City Councilmember Linda Atkins to the seat on the North Coast Railroad Authority currently held by über-railfan Charles Ollivier. Ollivier, a former longshoreman, represented the McKinleyville area on the board of the Humboldt Bay Harbor, Recreation and Conservation District until 2007, when he was handily defeated by fish biologist Pat Higgins in what amounted to a referendum on the wispy harbor-railroad scheme.

The staff report for tomorrow’s item notes that three candidates submitted their application for Ollivier’s seat — Atkins, Arcata City Councilmember Michael Winkler and former state senator, Arcata City Manager and ncra Executive Director Dan Hauser....


Obviously, the two Supervisors who put this on the agenda do not care about qualifications.

Note - In response to mresqaun in comments below: This is not necessarily about Linda Atkins = has there been any discussion about this matter in open session? Has the Board discussed this appointment? And made a public decision on this appointment? Has the public provided input?

Or did two - or three? - supervisors decide, on their own who was to be appointed?

Perhaps someone just made a mistake in writing this thing up - and these two Supervisors were just making their preference known ahead of time, and an underling made this error.

Lovelace and Local Solutions

☛ ER Lovelace donation request a concern in 2nd District
When 3rd District Supervisor-elect Mark Lovelace sent a letter to his supporters thanking them for their help in electing him as the Arcata-area representative to the Humboldt County Board of Supervisors, it didn’t raise any eyebrows.

But when the letter dated July 14 went on to thank the political action committee Local Solutions for its help in his successful effort in the June 3 Primary Election and asked for donations for them, some people in the 2nd District were concerned.

“Local Solutions has been actively involved in many local grassroots campaigns in the past, and is currently engaged in the upcoming November election for Humboldt County 2nd District Supervisor,” Lovelace’s letter states. “Their innovated resources can be developed further to better serve future campaigns, but only with our help.”

Lovelace said it wasn’t the intent of the letter to support 2nd District Candidate Clif Clendenen, who has been helped with in-kind donations already from Local Solutions, nor was he trying to persuade his supporters to do the same.
