◼ Well, look at this: link - Lost Coast Outpost prints the DA's PRESS RELEASE, which DOES NOT tell the story of how Gallegos/Zach Curtis tried to tank this case.

It is a grotesque misrepresentation of the story of the verdict. You can read the lousy thing at the link. The only good thing you can say is the DA's Office finally does seem to grok that there were life-threatening injuries.

A couple of comments shed some light:

Jacqueline Zumwalt • The district attorney was going to let her plea out to an assualt charge. Angel had to get a lawyer. The judge finally denied the plea agreement and made her stand trial for a felony charge. It took Angel 3 years for justice to be served. I wish that LoCo had told more of the story. If Angel hadn't fought hard for that justice, that woman would have been let off with probation. I hope the new DA better serves the Humboldt community.

Angel Dawn • Thank you. Allison Jackson is a hero. She took my case, probono, two hours before this crime got a three year probation result. It's sad the DA's office didn't do their job themselves. I hope Maggie Fleming can turn that office around for the better. I got lucky. Think about how many cases didn't get proper justice :/..it's stomach turning

swede • If you all would read the Chiv blog regarding this case, I don't have a link, you will learn that Gallegos twice attempted to gain a plea bargain for probation for this convicted vermin apparently falsely asserting special circumstances existed. Allison Jackson had to represent the victim because the DA was more concerned with expediting the prosecution (sic). Per the blog, Jackson represented the victim in front of Feeny and Feeny denied the plea bargain as Jackson successfully argued the special circumstances did not apply and the wounds received by the victim were evident the criminal was attempting to eviscerate her (purposeful "J" incision with severed liver, etc). A status was set for June 30th of this year. Apparently when Jackson and the victim appeared on the 30th they learned Gallegos had already in early June attempted and achieved his same plea in Reinholtzen's court. As I understand, Jackson had that matter reversed.

Jackson rightfully called out Gallegos for "forum shopping" attempting to find a judge who would approve his plea bargain attempt while totally disregarding the victims rights per a recently passed proposition requiring DAs' to notify victims of prosecutorial actions against their assailants.

It is a relief to see that this matter was finally brought to its rightful, final conclusion. We all should be relieved Gallego's time as the top law enforcement officer in this County is now numbered in the days.

Jacqueline Zumwalt • Excellent Swede. Thank you for posting that info/history. Gallegos actually told Angel that she had no rights or say in what deal was made with the woman who tried to kill her.

John Chiv was the only one to cover the case as it went its tortuous way through the courts. LoCo is remiss in not pointing this out and linking people to the coverage - OR asking for a full report with a byline. As it is, you don't know the half of it. But those commenting DO.

Tuesday, May 29 at approximately 6:45 p.m., officers responded to Mad River Community Hospital on the report of a woman arriving at the emergency room that had just been stabbed....The victim attempted to flag down the suspect to speak with her adult son who was in the vehicle.

According to Arcata Police, when the suspect and victim pulled their vehicles off the roadway, the discussion turned to an argument. During the argument, the suspect slashed the victim across the abdomen with a knife, resulting in a moderate injury requiring hospitalization.

Judge Reinholtsen said he had received Ms. Jackson's letter and a letter from Mr. Sanders and while he had reviewed the file, he needed to review it with depth. One of the reasons he mentioned was the three month plus Bodhi Tree trial and that he could not delay evidentiary rulings and reviewing jury instructions because they had already lost two jurors and one alternate and there are other schedules to consider after August 11.

He mentioned two options: one to hear oral arguments from all three attorneys, then rule a week from now or do everything on one date. Both Ms. Jackson and Mr. Sanders said there was no rush and they were willing to wait for the ruling. The next hearing is on August 13 at 2 p.m.

Brain Drain. Bad situation gets worse: Allan Dollison out

Humboldt County District Attorney Paul Gallegos confirmed Tuesday that Allan Dollison no longer works in his office as a deputy district attorney.

Gallegos said he could not comment on whether Dollison -- a United State Army veteran who served tours in Afghanistan and Iraq -- had resigned or was terminated on Friday. He was hired by the office in 2006.

”Certainly, I appreciate all of Allan's work with the District Attorney's Office and his commitment to his community and country,” Gallegos said Tuesday. “But other than that, I can't discuss the nature of his leaving.”

County Human Resources Department Director Dan Fulks said he could not immediately comment on the circumstances surrounding Dollison's departure....

Early in his career, Dollison was disciplined by the State Bar.

In August 2000, Dollison received a 60-day suspension of his law license and was placed on two years' probation after stipulating to 16 counts of misconduct in four consolidated cases, according to the State Bar.

Those included failing to perform legal services competently or respond to client inquires; improperly withdrawing from representation; failing to return client files and unearned fees; and two counts of failing to cooperate with the bar's investigation.

The State Bar report stated as a mitigating factor that Dollison started a solo law practice soon after passing the bar, but due to a lack of experience and business acumen, he accepted difficult cases for relatively low fees.

When he was hired by Humboldt County District Attorney's Office in 2006, Dollison said in an interview with the Times-Standard that he got in over his head as a new attorney and took on more than he could handle at the time.

Paul Gallegos’ listless DA Office leadership is defined mostly by constant explaining and excuse-making, a supposed law-and-order DA with an uncanny knack for letting bad actors off on technicalities.

The other salient feature of the Gallegosphere is strenuously projecting progressive-hipsterism while running a very traditional, fairly brutal politics-as-usual machine....

In 2003, the year Paul Gallegos began his first term as district attorney, the Department of Justice reported 394 violent crimes in Humboldt County. If that seems like a lot, fast-forward to 2009 when that number had risen to 541 -- an increase of 37 percent. During that same period, the overall rate for violent crime in the state declined by almost 20 percent.

But I want to talk about something more than numbers. I want to tell you what this looks like on the ground.

Here's an example. In July, a man named Michael Coen was arrested for attempted murder. This was not his first brush with the law. He'd been sent to prison for eight years for an assault that left a man in a coma. This was before Gallegos was elected.

Coen was paroled in 2007, but in March 2008 was picked up for participating in a gang. No charges were filed, and instead the new offense was treated as a parole violation.

In July 2008, he was arrested for his involvement in another beating that resulted in serious injury. Again, no new charges were filed by Gallegos, and again the offense was treated as a simple parole violation. Coen was out in five months.

December 2008 found Coen arrested yet again -- this time for driving under the influence and running from the police. Gallegos charged the DUI, but then pled it down to a less serious offense. Once again, it was treated as a parole violation.

Back out on the streets in May 2009, Coen was immediately re-arrested for participating in a gang. Again, no charges. Another parole violation; another brief stint in jail.

Coen was released again in August 2009. The following month, he assaulted two men, breaking the jaw of one man who happened to be a serviceman home on leave from Iraq.

Even though Coen was already on parole for felony assault, and even though he had five prior parole violations, Gallegos plea bargained this new case and agreed to Coen's release in November 2009.

Three months later, Coen was arrested again. The charges this time -- robbery, car-jacking, illegally possessing a weapon, and participating in a gang. The case was referred to the DA, but for some unexplained reason, it was never charged. At all. Even though the investigating officer reported Coen admitted his involvement. He remained out on the street until he was picked up a few months ago for allegedly attempting to kill a man.

This is one example. There are many more. This year alone there have been 29 felons on parole found to be in possession of firearms. The DA charged only six of those. One parolee was picked up three times for being in possession of a firearm before he was charged. That was when he was found with a loaded Glock in his waistband after being stopped by the California Highway Patrol.

This is where we are. This is what eight years of Gallegos has gotten us.

If elected as your next district attorney, I will close the revolving door of plea deals that returns violent criminals to our streets to offend again and again.

I will evaluate cases personally to make sure they are properly charged. I will prioritize cases and see that deputy prosecutors have the resources and leadership they need to succeed.

I will repair the damage done to the Victim Witness Program, and re-establish special victims programs, such as those that previously supported victims of domestic violence, sexual assault and child and elder abuse.

I will re-establish a true environmental crimes unit that addresses real issues and doesn't waste our time -- or your money -- on vanity cases and political grandstanding.

I will be accessible. People trying to contact the DA's Office will no longer get a telephone tree, a full voice-mailbox and no return call. That has gone on too long and is flatly unacceptable.

On the strength of my experience and reputation, I have earned the endorsement of law enforcement throughout Humboldt County: Sheriff's deputies, Arcata Police, Eureka Police, Fortuna Police and our correctional officers. I have the support of the current sheriffs of Humboldt, Mendocino, and Del Norte counties. They know I'll do the job to keep our community safe, and they know that when they arrest people and we can prove that they're guilty, I won't let them go.

Gallegos is going big in the race, spending well beyond his current means. It’s a gamble that may pay off in the General Election, but it could also be a hefty debt if that battle heats up, which it probably will. In the current cycle, he raked in $11,127 in contributions, most notably $1,500 from Humboldt Hydroponics, $500 from {yougofree.com}Jeffrey Schwartz, and $300 from the Humboldt Patient Resource Center, and spent $11,225. He took out another $3,000 loan and spent cash mostly on salaries, polling data, and credit card bills.

Allison Jackson raised $2,703 and spent $28,166. She took out her first loan in the race to the tune of $10,500. She got a $1,000 from Paradise City Publications, in Arcata, and paid off $12,656 in expense debt.

Weirdness abounds in the District Attorney race. Incumbent Paul Gallegos is the fundraising champion in this period, with $27,093 taken in — however, $20,000 of that was from a loan from a David Gallegos of Weston, Fla. David G. also chipped in a $5,000 donation. Gallegos also appears to be outsourcing his campaign — the physical address for his campaign committee is a West Hollywood office apparently belonging to a political consultancy called “ml Associates.” Meanwhile, the da candidate with the least name recognition — former prosecutor Kathleen Bryson — has, according to her disclosure forms, apparently accomplished the very unusual trick of raising $8,450 in increments of less than $100 while taking in only $300 in donations above that amount. Bryson has also loaned her campaign $5,000. Fellow challengers Paul Hagen ($10,347 raised) and Allison Jackson ($13,674) are close to neck and neck, though Hagen got there with the help of $7,400 in loans from himself and his campaign treasurer, Eureka conservationist Maggie Herbelin.

EUREKA – With more than 100 people who turned out in support, attorney Allison Jackson formally kicked off her campaign in Eureka Saturday afternoon to be the next Humboldt County District Attorney.

Campaign chairman Ron Pierre said the district attorney position is the most important in the county and called for strong leadership in that post.

Pierre noted that the crowd who came to support Jackson was a diverse mixture of residents from across the political spectrum.

Fifth District Supervisor Jill Duffy, who also attended the campaign event, said that Jackson alone possesses the experience and tenacity for the job.

Jackson is a partner at the Eureka-based Harland Law Firm where she has worked since 2004 representing clients in civil litigation, land-use, employment, and other areas of law. Jackson has also worked in the Humboldt, Santa Cruz and Santa Clara county district attorney offices.

Jackson said that as district attorney, she will show leadership and get results–not just give lip service.

“When I am elected you will finally have a district attorney who actually runs the office and who actively works to make sure that the laws are enforced,” Jackson said. “People will be charged and their cases will proceed based upon the evidence of what they have done and not who they are.”

Jackson said she will treat victims and witnesses of crimes with simple human dignity, adding that her core values and principles of law and order were instilled in her by the three generations of formidable women who raised her.

Former Humboldt County Administrative Officer Loretta Nickolaus called Jackson a veteran prosecutor who knows what it takes to administer the district attorney’s office.

Nickolaus said Jackson knows the Penal Code, can give clear jury instructions and gets sentences that fit the crime. She also gave a stern warning to those who might break the law.

“Allison won’t fool around here,” Nickolaus said.

Nickolaus said Jackson is a fierce and effective prosecutor who will represent everyone. She said Jackson brings a wealth of experience and will be there for the victims of crime and their families.

After months of speculation, former prosecutor Allison Jackson officially confirmed today that she will seek to unseat her former boss, incumbent District Attorney Paul Gallegos, in the June elections. A formidable and even frightening trial attorney, Jackson can now be expected to lay out the case against Gallegos at a pretty high temperature. There is no love lost between the two.

Jackson joins fellow former prosecutors Paul Hagen and Kathleen Bryson in the race. Gallegos himself had his campaign kickoff event earlier today....

Allison Jackson to Join District Attorney Race

Former Humboldt County Senior Prosecutor Allison Jackson will announce her candidacy for the office of district attorney tomorrow at a campaign kick-off in Eureka.

A highly respected trial attorney with two decades of courtroom experience, Jackson will be introduced by former County Administrative Officer Loretta Nickolaus and Fifth District Supervisor Jill Duffy.

“Allison is exactly who we need as our next district attorney,” Nickolaus said. “She has the experience we need and the integrity we can trust.”
Nickolaus called Jackson’s trial record “impressive” and noted that the former deputy da lost only one case in ten and a half years with the Humboldt County District Attorney’s Office.

“Allison is committed wholeheartedly to prosecuting bad guys to keep our children, families and communities safe,” Nickolaus said.

“Allison has a reputation for tackling tough cases, taking them to trial and getting sentences commensurate with the crimes committed,” Duffy said. “She also has developed strong relationships with local agencies and nonprofits dedicated to public safety and victims’ rights. I’m confident that she will make Humboldt County a safer place to live and raise our families.”

Jackson, 50, is a graduate of California State University San Francisco and Santa Clara University. She was admitted to the bar in 1991 and has practiced criminal law for 15 years and civil law for five. She is a partner in The Harland Law Firm, with offices in Eureka and Fortuna.

A trial attorney with two decades of courtroom experience, Jackson will be announced at today's event by former Humboldt County Administrative Officer Loretta Nickolaus and Humboldt County 5th District Supervisor Jill Duffy.

Jackson, 50, of Hydesville, is a graduate of California State University San Francisco and Santa Clara University. She was admitted to the bar in 1991 and practiced criminal law for 15 years, and civil law for five. She is a partner in the Harland Law Firm, with offices in Eureka and Fortuna.

Jackson's announcement will take place from noon to 1 p.m. today at the Aquatic Center, 921 Waterfront Drive in Eureka.
