Pled out - 8 counts reduced to unlawful sexual intercourse, false imprisonment and human trafficking in plea offer

After the case being dismissed the first time, mistrial the second time, a plea deal was reached right before the third trial started for David Anderson, a suspect who was originally charged with kidnapping, rape by force, forcible oral copulation of minor victim over age of 14, sexual battery, unlawful sexual intercourse, threats to commit crime resulting in death, false imprisonment and human trafficking.

Anderson has been represented for all three trials by private defense attorney Benjamin McLaughlin, who was appointed by the court as Anderson's attorney. The case was prosecuted each time by DDA Luke Brownfield....

◼ Sentence in human trafficking case: 9 years, 4 months - Will Houston/Times-Standard
Brownfield said in an interview with the Times-Standard that the plea deal was reached during a third trial in the case. During the first trial, other alleged "pimping and pandering" victims of Anderson's from two other California counties also testified, but Brownfield said the case was dismissed. When the district attorney's office refiled, the trial went on for about six to eight weeks before a mistrial was declared based on a statement made by a witness. Brownfield said it was about three weeks into the third trial when "we reached a negotiated deal to the human trafficking charge."

...Before the sentencing, McLaughlin asked Reinholtsen to consider waving or reducing the fines associated with the case — which included a $500,000 fine for the human trafficking charge — due to his client not having "the resources to pay any significant fines or fees."

And, another big one...

◼ Allegations of kidnapping, human trafficking, forcible rape and more in Anderson jury trial - John Chiv/Words Worth.

The allegations above also include oral copulation, sexual intercourse with force and violence, one alleged victim between the ages of 14 and 18 and sexual battery. And this is just the charging document.

Today DDA Luke Brownfield and Anderson's attorney, Ben McLaughlin gave opening arguments....

The defense had filed a motion that there was failure to provide adequate discovery. Count 1 of kidnapping and Count 6 threats to commit crime resulting in death were dismissed earlier in the case. The case was dismissed the day jury trial was to proceed.

Currently California Evidence Code 402 hearings are being conducted in Courtroom 1 for the David Anderson case. Ben McLaughlin, defense attorney; Luke Brownfield for the People. Judge John Feeney is trial judge. These hearings are happening at the same time the Bodhi Tree trial is going on...

Previous info on this case:

In addition to the charges from the first case, an additional count added: human trafficking involving a minor. This is Count 8. Penal code 236.1 (c)
Also added were two counts of special allegation of felony sex offense and serious sex offense have been added to the charges. Bail that was set at $850,00 has not yet been posted.

Judge Miles presided over the preliminary hearing in the case that had been refiled. Anderson was arraigned for jury trial. Ben McLaughlin, defense attorney; Luke Brownfield for the People. Judge John Feeney is trial judge.

A previous case involving David Anderson, a felony with charges of kidnapping, rape by force, forcible copulation of a minor victim, sexual battery, unlawful sexual intercourse, threats to commit crime resulting in death and false imprisonment was prosecuted by Luke Brownfield for the People with Ben McLaughlin representing the defendant was dismissed on 2/24/14 by Judge Feeney. The defense had filed a motion that there was failure to provide adequate discovery. Count 1 of kidnapping and Count 6 threats to commit crime resulting in death were dismissed earlier in the case. Paul Gallegos gets continuance in defense request to dismiss Warren case

◼ There were supposed to be oral arguments in the Jason Warren case today. - John Chiv/Words Worth

...Defense filed a motion to dismiss certain counts. Judge John Feeney presiding in Courtroom 1, Kevin Robinson representing Jason Warren and District Attorney Paul Gallegos is prosecuting the case.

Today oral arguments were supposed to be heard on a 995 Motion. A California Penal Code 995 motion is a request for the judge to dismiss one or more counts of the complaint. A motion to dismiss can be filed after a preliminary hearing on a felony case.

The defense was requesting that counts 2, 3 and 4 be dismissed. Mr. Gallegos asked the court to review all exhibits in the case before the 995 hearing and making a decision. Judge Feeney agreed and granted Mr. Gallegos' request. The defense and Warren submitted on the continuance.

The oral arguments will be heard on March 27 at 3 p.m.

Another high-profile case, David Anderson with Luke Brownfield for the People and Ben McLaughlin for the defense. Anderson was arraigned on complaints filed on March 11, 2104. This case was re-filed....

Courtroom 1 was the happening courtroom to be in today with Paul Gallegos, Patrik Griego, Ben McLaughlin, Allan Dollison, Glenn Brown and few others all in the same afternoon. Sort of a star-studded attorney line-up. The Littlefield case was also on calendar today, which is being prosecuted by Mr. Gallegos.

CASE TOSSED The district attorney misrepresented the law and failed to provide evidence of former Eureka Police Chief David Douglas' and Lt. Tony Zanotti's innocence during a criminal grand jury inquiry into the 2006 shooting death of Cheri Lyn Moore, defense attorneys argued in court documents filed Thursday... ”Our judicial system stands as a real and necessary check on the grand jury indictment process,” one of the documents states. “This court has the authority and the means by which to halt this prosecution, which is justified neither by the undisputed facts, nor by the law.”

Gallegos has taken what was "arguably the state's best small DA's office, with a cutting edge CAST program that "trained the trainers"... into a bunch of time serving bureaucratic wannabee brown nosers, lightly sprinkled with a couple of earnest learners who are sure to split as soon as possible.

One weeps for Max Cardoza who won Angellel, and for Maggie Fleming who won so many impossible victories. Mired in Humboldt for personal reasons, they have to suffer the ignominy of working for Paul, with Yougo, yes, yougo who has freed more people as a prosecutor than he did as a defense attorney. He likely sounded the same way when promising to get prosecutors off their anachronistic “at will” status and onto civil service status. It never happened. ★ Note the difference between what he SAID, and what he DOES..."...So what are these issues? Top on Gallegos' list is the proliferation of "garbage cases," small-time crimes and overcharged cases that he said are clogging up the court system.

Garbage cases, said Gallegos, come in two forms: Cases that would lose if actually brought to trial and cases that are overcharged for the crimes committed. The idea behind filing both kinds of garbage, he said, is to get the defendant to plead guilty, netting a conviction without having to go into court.

Again, the IRONY is astounding! Look at what he SAYS, and then think about what he DOES! "Probably 95 percent of the cases that are filed plead guilty. In fact, there are a lot of cases that are filed on the assumption they will plead guilty, because of the time and expense involved in defending them. But these cases shouldn't even be filed in the first place, because if they were challenged, they would lose," Gallegos said.
