The complaint alleges that Diane Johnson, 58, of Miranda, caused the death by driving negligently. The charge is a misdemeanor because there is no evidence that Johnson was on alcohol or drugs, Gallegos said in a release.

Rose: the difference between a misdemeanor and a felony is not "alcohol or drugs," it is whether or not there was gross negligence or not.

I don't recall hearing the results of any toxicology test. Was there any drug or alcohol testing done?
