California Bar Journal

***URGENT UPDATE/ALERT! This case was TOSSED by the Judge - never made it to trial,

Feeney said the indictments the grand jury handed down to Douglas and Zanotti in December 2007 weren’t supported by probable cause. Insufficient evidence regarding the former leaders’ alleged failure to oversee other law enforcement was also presented to the grand jury, Feeney said, and instructions given on “exigent circumstances” were inadequate.
The grand jury should have also been instructed on justifiable homicide by law enforcement officials, Feeney said.

Misconduct charges for 3 prosecutors
In three disciplinary cases pending before the State Bar Court, current or former deputy district attorneys are charged with committing acts of moral turpitude and disobeying the law. The bar alleges that two of those charged withheld exculpatory evidence.

Fascinating.

Gallegos' withholding of critical evidence in the Douglas/Zanotti persecutions fits into that category, as does what happened with Debi August. Wonder if there is a statute of limitations on these things.

  1. Why is it that two of the most vile and vociferous advocates for "police review", Greg Allen and Christina Allbright, both attorneys, loudly state that the police can't police themselves due to conflict of interest, but those pillars of ethics and morality, attorneys, can?

  2. And Doctors can. And Teachers can. And Senators and Congressmen can.

  3. All true. But attorneys? lol

  4. Unfortunately Paul has a legal defense that even his most strident detractors will have to acknowledge. He can't be charged with misconduct when he's only guilty of incompetence.

  5. That may be his only defense (incompetence).

In reality Paul knew exactly what he was doing. Paul was serving notice on the local law enforcement for participating in the recall effort and criticizing him publicly. Kind of look what I can do to you if I want, so stay in line.

We can't leave out the segment of Humboldt County that thinks Paul is great for going after the cops; the dope growers, the dope users, the homeless, and the thieves. Guess I should throw in the enviro's too.

This Gunderson thing was the best thing that ever happened to Paul. A real bad apple to go after. And i'm sure he's messing that up too.

The key is WITHHOLDING EXCULPATORY EVIDENCE.

I wonder what Mike Nyfong is doing these days?
