Arraignment for trial on June 10 at 2 p.m. in Ctrm 4. Judge Wilson said counsel had good arguments and while he saw evidentiary issues and potential problems with jury instructions, he said Ferrer's actions did meet implied malice and that use of a knife in a physical alteraction was similar to bringing a gun to a knife fight.

PREVIOUSLY: Gallegos informed Reinholtsen that he had not had the opportunity to speak with Anderson-Jordet's family

Humboldt County District Attorney Paul Gallegos said... he has reassigned the Douglas Anderson-Jordet fatal stabbing case from Deputy District Attorney Elan Firpo to himself.

”It was my own inner sense of justice for everyone involved and my disappointment that some would use this case for political purposes instead of trying to seek justice,” Gallegos said....

So, WHERE was Paul?

  4. So why is the prosecutor, apparently not Paul letting this evidence in, like the fact that the victim was inquiring in the past about purchasing heroin. That is so irrelevant it is not even funny. This is not admissible. It looks like the case is being thrown (a fight-fixing term) so that an Invol Manslaughter holding will occur, and make Firpo look like some sort of prescient legal genius.

  6. Anon @ 10:30: so now if the court finally sentences with involuntary manslaughter, it's because the case was thrown? Give me a break. Even if the defense is asking about possible heroin connections, that doesn't mean that the prosecution or judge will allow it to be admissible. This isn't a jury trial yet, you know. It sounds more like you're just trying to smear Firpo's name, yet again.

Maybe now that actual evidence is being introduced, you could actually go into detail about what you're talking about, beyond it just being Firpo's fault? :)

    Even if you have a law degree, your opinion is just that, an opinion. You are not the Judge or attorneys in this case.

    Think Arnie and Maggie are panicking because evidence supports what Firpo said.

    They will need to get their bloggers to bring back the only so many years line in desperation.

    Firpo's deal may fall short of the sentence for a murder conviction, but it's certainly 4 years more than if Ferrer ends up acquitted due to prosecutorial overcharging. See, for example: http://www.huffingtonpost.com/bennett-l-gershman/george-zimmerman-charges_b_3529636.html

    While your concern in this case may be heartfelt, politicizing a case to the extent that the prosecution can no longer do their job does nothing to help the cause of justice. If you argue that this is not politically motivated, I'd ask where you were during Larry Morrow's case, when he was given just one year in jail for fatally stabbing a man.

  16. Anon @6:26pm 5/30/14 - Go suck it. Kelly is BEYOND anything that Firpo (who you obviously support since she already tried to send Kelly packing with the help of Gallegos & Hislop) could ever hope to become.

    No one in that office wants Firpo to win. That says A LOT about her and what her co-workers think of her. Who would they prefer to run...Kelly. :)

  20. If you want a DA who uses supporters working in the DA's office to release personal information and office information irrelevant to this race, about another candidate and their supporters, vote for Maggie or Arnie.

    That is if you want that kind of DA deciding your fate.

    If you want a DA who talks about why they should be elected, vote Firpo or Dollison.

  21. People leak information because they are frustrated by the ineptitude in that office and feel they have no other recourse.

    The Ferrer case is political to the extent that the incompetence that lead to that plea bargain is exactly WHY Arnie and Maggie are running.

    Elan does not know what she does not know and her ego prevents her from recognizing her own limitations at the expense of public safety. Not only does she lack experience, what experience she does have as a prosecutor was gained under the "mentoring" of the head fool himself, Paul Gallegos.

    Dollison? No. He is lucky to have gotten his law license back. Forging a judge's signature is NOT an innocent mistake. The fact that he is asking voters to make him the most powerful attorney in the county in and of itself is proof of his lack of judgment and his arrogance.

    Someone asked for three reasons why Arnie should be elected. The following three reasons apply to both Arnie and Maggie:

    1)Experience, experience, experience. If I were feeling glib, I would end it there. And no, not experience being a middle manager in a company that outsourced manufacturing overseas.

    2)The proven capacity to mentor new deputy DAs. Elan is so green, she still needs mentoring, both in knowledge of the law and in her professional ethics. What a low moment when she publicly besmirched a murder victim's character to rationalize her ineptitude! Girl, no matter how fast you hit that delete button, nothing ever dies in cyberspace. . .

    And then there is Dollison. Don't worry about your caseload. Here's how to forge those pesky documents. See? Easy. . .

    3) Actual concern for the people of Humboldt County. Yes, I do want a DA whose priority is to serve the people. Not circle the wagons to hide ineptitude and soothe wounded egos. Not someone who looks the other way when public safety is eroding, when the people have lost faith in the officials they elected to protect them.

    Each vote is a bond of trust. That trust should never be dismissed, disdained, or denigrated. Keep that in mind when you decide on the "kind of DA" to whom you will entrust your fate.

    No getting around Firpo's lies. What she tried to do, was inexcusable.

    AND, she never referred the murdered victim's family to Victim Witness.

    That should have got her fired. With any other boss, she would have been.

  29. There is nothing in the Times-Standard saying anything about three wounds in their coverage of the recent preliminary hearing.

    No other "paper" reported on that case about that recent hearing. I was there in the courtroom as an interested public citizen. The only other coverage of that preliminary hearing was from Channel 3 and on John Chiv's blog.

    I did not read about three stab wounds. I did not hear that in the courtroom, so 3:06 you keep lying.

    THAT WOULD BE THREE KNIFE WOUNDS - one in his heart, one in his side, and one on his hand - AND A LACERATION IN THE UPPER LIP.

  31. 7:24 you need to learn to read. You also need to be present at the hearing before you claim to be correct. Not interpret a reporter's hearsay as gospel.

    There is a difference between three stab wounds and three wounds. A cut is not a stab wound. The puncture wound has not been identified as a stab wound. It has not been determined what, if any weapon caused that cut.

    There was testimony in court that wounds could have been inflicted when medical staff was cutting off layers of clothing. There were lot of inconclusive determinations by the Coroner.

    There was also testimony that more than one assailant could have caused the injury.

    So before you shoot your mouth off, again, get the facts.

    What you want to do is spin information to make it look look bad for Firpo.

    You have no interest in this case other than to exploit a tragedy for your own benefit. Go crawl back under the rock where you belong.

  35. I don't think you understand. Fleming doesn't go on these blogs. So how do these blogs show her dishonesty?

    I do see plenty of evidence of ANONs throwing mud at her and twisting the facts to try and make her look bad, but no actual evidence of her dishonesty or incompetence.

    The nonsense about CAST, John Wright's check, the Sheriff's money etc are all storms in a teacup. Sound bites taken out of context twisted and thrown back on this blog such that the truth has been eliminated and only spin remains.

    Everyone who knows Maggie knows that her honesty and ethics are beyond reproach. Everyone who has ever met her knows that she is beyond competent and the clear choice for DA. That is why those trying to build up another candidate have gone through so much trouble to depict her otherwise.

    One can only hope that before people vote, they rely on reality, and not this blog, to inform their voting decisions.
