Where is Paul Gallegos?

Today in Courtroom 4, the Ferrer case was scheduled for status of discovery and a motion to dismiss the case against Sophie Rocheleau. Paul Gallegos, who is prosecuting the case, has missed several court dates and hearings have been continued several times.

That happened again today. ADA Kelly Neel told the court some time when the hearing was underway that Mr. Gallegos is ill and that decisions regarding issues brought up by Mr. Marek Reavis who represents Juan Ferrer and Mr. Benjamin Okin, who represents Rocheleau, be discussed when Mr. Gallegos is back next week....

"Every week we come back and hear the same excuse," was Mr. Reavis' response and frustration when Ms. Neel responded to his statements at the start of hearing.

Several times, Mr. Reavis and the attorneys have requested X-rays and information on autopsy essential to their case, and finally today, only Mr. Reavis received two CDS, both which he said were duplicates. There were two dozen "images that had never been discovered before, according to Mr. Reavis." He told the Judge that "this is material that should have been discovered the first week."

He told Judge Reinholtsen he renews his request for sanctions. Mr.Okin and Ms. Jennifer Dixon who represents Nicholas Stoiber did not even get these CDS. - Read the rest.

    1. How do we know you are employed? Paul Gallegos gets paid over $13,000 a month plus benefits. Rose is not the District Attorney.

  2. What's classic here is PVG's slackitude. He ran for this office, spouted moronic platitudes about the job, got re-elected by the low information voters and the stay away disillusioned, and is slumping out of his responsibilities just as some people, including Rose, tried to tell you. What's also classic is the attack on Rose, who is the messenger, and not on PVG, who is the problem.

      Oh what will she do with her free time come January? With any luck Measure R will pass giving Rose some extra cash when she finally finds that first paying gig.

  4. Gallegos is not even doing BASIC stuff, like providing discovery to the defense. Since 'anon' is likely one of his spin doctors who likes to preach about 'social justice' and all that, how does this jibe? A defendant has a right to see the evidence against them. Simple, basic. Elementary stuff. Oh, ok, I guess we see now that all that social justice bs was just more crap spun to win an election, lying to the people doesn't phase you in the slightest does it - 'anon'? Like we don't know who you are.

  8. This is what the DA in Solano County did! He lost (which by proxy PVG lost when Firpo lost) and the DA resigned. The elected DA just took over. Too bad Ms. Fleming can't nudge Mr. Gallegos along, because it is obvious that he is doing real damage to the office and its cases.   9. The only reason that worked in Solano is that the new DA was in the office:
    Abrams defeated du Bain in the June 3 election .... du Bain notified the county Board of Supervisors that he is resigning ... Abrams, a prosecutor in the office, was initially set to become district attorney at noon on Jan. 5, 2015.The state government code allows a chief deputy district attorney to perform the duties of the district attorney when the office becomes vacant.

  10. Does the Article not say this, as well? "The Board of Supervisors may also appoint a new district attorney to serve the balance of du Bain’s term or appoint the district attorney-elect." Would the BOS appoint anyone other than Fleming? Understand that there is no way that Gallegos will finish any of these other cases. If he is lucky he will get a Hung Jury in Lee. According to Court-watchers he is boring the heck out of the jury. He already hung Curry. Gallegos needs to step down, and the BOS can appoint Fleming. That is what the county wanted. Is that what you wanted?

  12. If the incumbent DA quits, the supes can appoint anyone they want.
    Government Code Section 25304. The board of supervisors shall fill by appointment all vacancies that occur in any office filled by the appointment of the board and elective county officers, except judge of the superior
    court and supervisors. The appointee shall hold office for the
    unexpired term or until the first Monday after January lst succeeding
    the next general election.

  13. If Gallegos were promised immunity from criminal prosecution in turn for resigning immediately, I bet you he would take that deal in a heartbeat. Someone make that call.
