Plea deal in the crossbow case.

Pleading guilty to the charges of voluntary manslaughter and attempted murder with enhanced allegations of using a crossbow and causing great bodily injury during a July 3 trial confirmation, Phoenix Triton King was sentenced to serve 18 years and four months in state prison. As King's defense attorney, (Humboldt County Conflict Counsel Greg) Elvine-Kreis said the decision to take the plea deal came after he and King compared their evidence with that gathered by the prosecution and determined that theirs was not sufficient to argue a perfect self-defense case.

"What happened is we got an offer for a determinate term," Elvine-Kreis said. "We balanced the evidence of what we had in a perfect self-defense case and determined that this was the better route to take. When you're looking at life in prison, you want to be assured of some things. In the end, we decided to take the offer for an out date when (King's) still somewhat young."

Crazy. Good choice? To plea out? Or not?

20-year-old man accused of killing a 44-year-old man with a crossbow in the Samoa dunes last Sept. will stand trial Monday. scheduled to be back in court on Feb. 27.

Phoenix Triton King, 21, has pleaded not guilty to charges of murder and attempted murder. His February trial date was also pushed back....When Miles asked if he was willing to waive time, King answered, “Yes, I am.”

King is scheduled to be back in court on Feb. 27.

A 29 20-year-old transient man named Phoenix Triton King and an unidentified 16-year-old girl are wanted on charges of murder and attempted murder after yesterday's brutal crossbow attack near Manila, which left one man dead and another injured.

A 44-year-old man was fatally shot in the face with a crossbow arrow yesterday afternoon while a second unidentified victim, a 41-year-old man, was hit with arrows to the hip, shin and head, according to the Humboldt County Sheriff's Office. The attack occurred near the southbound shoulder of State Route 255 and New Navy Base Road.

Sheriff's deputies believe the attack was motivated by an alleged theft at a nearby transient camp....

A Humboldt County Superior Court judge is continuing the process of determining whether a 16-year-old girl accused of murder should be tried as an adult.

Lake County resident Rosalie Adams, who has pleaded not guilty to charges of murder and attempted murder, appeared in court Thursday, where Judge Joyce Hinrichs gave the Humboldt County Probation Department additional time to prepare a report recommending whether it feels Adams is fit for the juvenile justice system. Court documents shed new light on the case against Adams and her alleged accomplice, 20-year-old Phoenix Triton King, indicating a stolen gun may have triggered the dispute that led to the shootings....

King faces a potential sentence of 40 years to life in prison if convicted in the case, as does Adams if she's tried as an adult. If convicted as a juvenile, she faces a maximum sentence of eight years in a juvenile detention center.

All but one are pending murder cases. Normally tried by seasoned prosecutors. Where are they? Who's handling these cases? Where's Max? The only senior Deputy DA left.

There is a tremendous amount of work that goes into prepping a case for trial. Or should be. Who's doing the work?

Implicit in all evidence gathered by the Grand Jury - including interviews with the D.A. (Paul Gallegos) - is the unfortunate truth that the D.A. (Paul Gallegos) exhibits a limited understanding of how things are done in the department" Gallegos "lacks the global perspective needed to keep the department operating efficiently," and quotes an unnamed staff member as saying, "The D.A. (Paul Gallegos) does not fully understand the functionality of many of the things we do here" - Years later, in his own words: "I’m not an administrator, they didn’t elect me to be an administrator, they elected me to make sure this office runs..."

One weeps for Max Cardoza who won Angellel, and for Maggie Fleming who won so many impossible victories. Mired in Humboldt for personal reasons, they have to suffer the ignominy of working for Paul, with Yougo, yes, yougo who has freed more people as a prosecutor than he did as a defense attorney. Gallegos has answers for everything. I’ve never met anyone whose answers came so quickly, with such polish - except about his law school(s). He likely sounded the same way when promising to get prosecutors off their anachronistic “at will” status and onto civil service status. It never happened. Indeed, he told them, “Disloyalty will not be tolerated” – a real morale builder.

Garbage cases, said Gallegos, come in two forms: Cases that would lose if actually brought to trial and cases that are overcharged for the crimes committed. The idea behind filing both kinds of garbage, he said, is to get the defendant to plead guilty, netting a conviction without having to go into court.

Again, the IRONY is astounding! Look at what he SAYS, and then think about what he DOES! "Probably 95 percent of the cases that are filed plead guilty. In fact, there are a lot of cases that are filed on the assumption they will plead guilty, because of the time and expense involved in defending them. But these cases shouldn't even be filed in the first place, because if they were challenged, they would lose," Gallegos said.
