At least we won't have to waste money on a trial

◼ Autopsy conducted at 1 p.m. for Killian Shane O'Quinn, suspect involved in Nov 1 shooting of CHP officer - John Chiv/Words Worth

The suspect, who died after shooting CHP officer Steve Curtis, is 20 years old, had a 45 caliber semi-automatic Springfield Armory pistol...

Chief Mills said the green sedan involved in the November 1 incident was driving erratically, forcing people off the road. Officer Curtis recognized the five occupants in the green sedan. After the car "rested on the curb", Officer Curtis walked over and talked to O'Quinn. Asked him to step out of the vehicle, which is standard procedure, said Chief Mills. "O'Quinn pivoted his feet to the ground and mumbled something like, I'm about to have a bad day." Chief Mills said Officer Curtis had to tell him to step out of the car three or four times. O'Quinn pulled a gun out of his waistband, "broke away from the Officer's grip" and shot the officer in the upper right thigh.

So, maybe the media will show up later after my post? Or the TS could always just call and have the DA's office fill them in and basically write their article. Maybe NCJ could pull some probation reports and string an article about William Nelson's past?

Why bother doing actual reporting? This is news, this is local. Reprinting press rleases and national associated press stories on issues that don't affect people should take a backseat to live coverage.

Eureka police shooting investigation awaits DA's decision... And....

◼ The district attorney's office will rule whether it was a justifiable homicide - Times Standard

...And, every so often, he does the right thing. Sad as it is for the families involved. It is the right choice.

◼ DA: No Charges Will Be Filed Against Officer for Death of Tommy McClain - Andrew Goff/Lost Coast Outpost

After reviewing the report in its entirety, the District Attorney’s Office concluded that that the evidence does not prove beyond a reasonable doubt that an officer committed a crime. Therefore, no criminal charges will be filed against any officer arising out of the September 17, 2014, shooting of Thomas McClain.

Specifically, the evidence establishes that, on the early morning hours of September 17, 2014, Thomas McClain was in possession of a BB gun that resembled an actual firearm. Thomas McClain was carrying the BB gun in the front waistline of his pants. The BB gun was perceived as an actual firearm by law enforcement officers. On lawfully engaging with Thomas McClain, law enforcement officers directed him to put his hands up and comply with their orders. At that time, the officers observed what they believed was Thomas McClain moving his hand toward the BB gun. Believing that the BB gun was an actual firearm, and that Thomas McClain would shoot them, the officers responded and Thomas McClain was shot and killed. The perceived firearm was later determined to be an unarmed BB gun.

The District Attorney stated that: “Thomas McClain’s death is a terrible tragedy. He is mourned by his family, his friends and this community but it was not caused by any criminal activity that I can see on the part of the law enforcement officers. My heart and my prayers go out to Thomas McClain, his family and friends and the law enforcement officers involved in this terrible tragedy. It is my sincere hope that time brings comfort and solace to all.”

◼ Kidnapping, attempted murder in SoHum - Times-Standard

The following is a press release from the Humboldt County Sheriff's Office:

On Friday at approximately 3 a.m. the Humboldt County Sheriff's Office received a call regarding a kidnapping and possible murder. Deputies spoke with a 24-year-old man and a 29-year-old man, both from Indiana, who were reported to be in the Laytonville area. The men reported on Thursday they were visiting with a 25-year-old male friend in the Ranch Sequoia area of Humboldt County. At approximately 10:30 p.m., on Thursday, the two men from Indiana were on the balcony of the residence when they heard vehicles drive up to the residence. They heard male voices yelling what appeared to be commands to someone, and then banging on the side of the home. The two men then heard multiple gunshots. The two men went downstairs to find out what was happening, and saw eight males with rifles dressed in camouflaged clothing covering their entire bodies. Each of the male suspects was carrying a high powered rifle. The males then tied the two men to a tree with rope. The two men saw their 25-year-old male friend, the homeowner, had been shot and was bleeding. The suspects dressed in camouflaged told the two men tied to the tree not to say anything or they would kill them. The suspects then ordered the 25-year-old male gunshot victim into a truck at gunpoint and left with him to an unknown location.

The two Indiana men were eventually able to untie themselves and fled the residence and the area. They were uninjured.

At approximately 3:30 a.m., the Humboldt County Sheriff's Office received a call from Jerold Phelps Hospital in Garberville. A 25-year old-male showed up at the hospital with multiple gunshot wounds. Deputies responded and met with the gunshot victim, who turned out to be the 25-year-old homeowner from Rancho Sequoia the two Indiana men had reported being shot.

The gunshot victim is expected to live. Humboldt County Sheriff's Detectives responded to the hospital and met with the victim who is expected to live. At this time the motive for the crime is unknown, and there are no suspect or vehicle descriptions.

Humboldt County Sheriff's Detectives obtained a Humboldt County Superior Court Search Warrant for the residence where the crime occurred which they served on 11-29-2013. Detectives located evidence at the scene consistent with the reported crime. The investigation is ongoing.

Attacker shot and killed by deputies

◼ TS Humboldt County Sheriff's deputies shoot man on State Route 299
An officer-involved shooting left an unidentified man dead on State Route 299 west of Blue Lake Saturday morning.

The man was shot multiple times after allegedly approaching officers aggressively with the metal handle of a garden rake, and refusing to comply with officers' orders, according to the Humboldt County Sheriff's Office. He died at the scene.

The Humboldt County Coroner's Office said the identity of the deceased is being held pending a positive identification. However, people at the scene who said they are relatives of the deceased identified him as Robert Garth, 31, of Blue Lake.

According to a Humboldt County Sheriff's Office press release, deputies responded to a report of an assault in progress around 7:30 a.m. Saturday near the Blue Lake Boulevard on-ramp to 299, just west of the city. The release states that a 35-year-old Arcata man, who was hitchhiking, called 9-1-1 to report that he was being assaulted with a metal-clawed garden rake.

Humboldt County Sheriff's Office Lt. Steve Knight said the assault remained in progress when a pair of deputies -- including one in training -- arrived on scene, but Knight said the assault had moved up onto the westbound lanes of the highway at that point. According to the release, the handle of the rake broke off during the assault, and officers arrived to find the assault victim and the suspect struggling over the rake handle.

When deputies pulled up in their patrol car, Knight said, the victim let go of the rake and ran away from the suspect. According to the press release, the suspect then turned his attention to the officers, and allegedly began advancing on them with the rake handle, which looked like a three-foot metal pipe.

The suspect, who was in close proximity to the officers, then allegedly raised the pole into striking position and came at the officers, causing them to draw their weapons, according to the release.

Knight said deputies repeatedly instructed the suspect to drop his weapon. However, the suspect kept advancing, Knight said, and deputies fired on him as they retreated backward.

Despite having been shot by the deputies, Knight said, the suspect kept moving toward them.

”He continued advancing, and the officers fired again,” Knight said.

Authorities arrested a man Friday evening who is a suspect in an alleged shooting that occurred Friday morning.
Michael Alan Coen, 28, was arrested at 7:35 p.m. on Highway 36 near Van Duezen Street in Alton after a concerned citizen spotted the suspect and called authorities, according to Humboldt County Sheriff's Sgt. Ernie Stewart.

”We spotted the suspect and he ran,” said Stewart. “After a brief foot pursuit, we caught him.”
He was transpoted to the Humboldt County jail, where he was booked on charges of attempted murder, resisting arrest and a parole violation.

At about 1 a.m., a man renting a room at the Garberville Motel on Redwood Drive reported that two men were outside his door yelling at him, according to a Humboldt County Sheriff's Office press release. When he looked through the peephole of the door, he saw one of the men was armed with a rifle.

The man in the hotel room moved into the bathroom and called 911. While he was on the phone with dispatchers, one of the suspects allegedly fired six or seven shots into the door, according to the press release.

Man shot by Eureka Police dies

◼ Man shot by Eureka Police dies
A Eureka Police officer shot a reportedly armed man in an alley off Summer Street at around 11 a.m. Thursday after a resident wrestled the man to the ground.

Humboldt County Coroner Dave Parris identified the man who was shot as David Sequoia, 25, of Eureka, and said that he was pronounced dead shortly after he was taken to the hospital. Eureka Police Chief Garr Nielsen confirmed that the shooting involved two officers with his department, but released few details about the incident.

On Thursday, Summer Street resident Kris Coon said he heard rustling in the carport of his home, and found a white man in his early 20s carrying a backpack. Coon said the man pushed him, and Coon wrestled him to the ground, then realized the man had a handgun in his belt. His wife had called 911, and police arrived quickly, Coon said.

The man refused to comply with officers' orders to give up the gun, Coon said, and an officer shot the man in the head.
”They gave him every chance in the world to comply,” Coon said....

From the comments: (comments threads have been shut down since this morning it seems)
Gumshoe said:

David Sequoia = David Gabriel Barger.
The first name, age, alias, and city of residence all match David Gabriel Barger, He stood trial for the first degree murder of Rex Shinn and was charged with the attempted murder of Alvin Pires and Brandon Fee. A handgun was discharged in both crimes.
Considering the deceased criminal history, I don't see how there could be any doubt that the use of deadly force by this EPD Officer was justified.

Here's what I have that's related: (heraldo has a thread up too: ◼ Slain suspect acquitted of murder in 2008
Preliminary hearing in murder/attempted murder case continued
...defense attorney (Neal Sanders) declared a conflict of interest Monday morning with regard to defending his client — a man charged in a 2003 murder/attempted murder case... David Gabriel Barger was to have his preliminary hearing — after which a judge would have determined whether there was sufficient evidence to warrant a trial — he was assigned a new Eureka-based attorney, Marion Miller.

According to past reports, Barger pleaded not guilty in late March to the July 19, 2003, murder of Rex Shinn; the Aug. 13, 2004, attempted murder of Brandon Fee; the Aug. 13, 2004, assault with a deadly weapon, being a firearm, of Brandon Fee; and the Aug. 13, 2004, assault with a deadly weapon, being a firearm, of Alvin Pires.

Barger, 22, a resident of Southern Humboldt — who has gone by the last name of Sequoia — also issued denials to the various firearms-related special allegations listed on the complaint filed by the Humboldt County District Attorney’s Office.

...The police report alone, Sanders said in a previous interview, is more than 1,400 pages long.

It's quite a story how this guy came to be in jail! Complete with a pot grow, drug deals, more offers of immunity from the DAs Office, a case dismissed the day the trial was set to begin back in 2006 and refiled in 2007...
☛ TS Barger murder trial to begin this week
More than five years after Rex Shinn was reportedly shot dead near the Southern Humboldt town of Honeydew, David Gabriel Barger is preparing to stand trial for his murder.

Jury selection is expected to continue Monday for the trial, in which Barger is charged with first-degree murder and stealing Shinn's truck.

Barger was also held to stand trial on a charge of attempted murder and two counts of assault with a deadly weapon, but those charges will be tried separately.

Shinn, 32, of Loleta, was reported missing July 19, 2003, by his mother, after no one had seen him for several months. His abandoned pickup truck was found a month later by a hunter near Petrolia.

More than a year later, in January 2005, Sheriff's Office investigators were led to Shinn's body, which was later identified through dental records....

According to a Feb. 17, 2007, Declaration in Support of Arrest written by Sheriff's detective Rich Schlesiger, Barger, Shinn and four other passengers piled into Shinn's pickup on the morning of July 19, 2003, and headed to the Honeydew property of Scott Starnes, parking outside his front gate.

Shinn and Barger then left the other passengers in the truck and went up and knocked on Starnes' front door, according to the report. Starnes reportedly told investigators that he was awoken by the knocking, and was on his way to answer the door when he heard several gunshots.

When Starnes opened the door, he found Shinn lying dead with a gunshot wound to the head and Barger running down the driveway, according to the report....

Because Starnes had a marijuana growing operation on the property, according to the report, and was afraid to call law enforcement, he told investigators that he and Cordrey decided to use a backhoe to bury Shinn's body near a pond on his property.

According to other documents in Barger's case file, both Cordrey and Starnes repeatedly denied having any knowledge of Shinn's death when asked about it by law enforcement and only admitted to their roles after being offered immunity by the District Attorney's Office....

Barger was soon charged with the attempted murder of Pires, but Humboldt County Superior Court Judge Timothy Cissna ruled in June 2006 there was not enough evidence to hold him over for trial.

Barger was arraigned on a complaint of the attempted murder of Fee the next month, as well as two allegations of felony assault stemming from the incident, but the District Attorney's Office dismissed the case the day the trial was set to begin.

The Humboldt County District Attorney's Office re-filed those charges Feb. 14, 2007, as well as the first-degree murder and vehicle theft charges relating to Shinn, after the case apparently caught a break. While still in custody on the unrelated charges, Barger allegedly confessed to two people that he'd killed Shinn, according to the investigator's report....

◼ Barger not guilty of first-degree murder
After nearly four days of deliberations, a jury found 23-year-old David Gabriel Barger not guilty of the first-degree murder of Rex Shinn, who was shot in the head on a Southern Humboldt County pot farm in 2003.

The jury could not agree on the lesser count of second-degree murder, and ultimately hung with eight of the 12 jurors in favor of his acquittal.

Barger was found guilty of vehicle theft for taking and hiding a truck that belonged to Shinn.

...Following the verdict, juror No. 1, who deliberated in the case, said she was unhappy with the outcome, but because the prosecution did not produce enough compelling evidence, the jury had no choice but to find there was reasonable doubt Barger committed the murder.

”It's very upsetting the evidence wasn't better,” juror No. 1 said. “It wasn't fair to the whole jury because of the evidence. They didn't give us enough.”

...witnesses were granted immunity for their involvement in the marijuana growing operation, and juror No. 1 said this was a primary concern during deliberation.

”Maybe if they had a witness without immunity it might have been more believable,” she said.

Gallegos said he understands the jurors' concerns.

”This murder revolved around a marijuana grow. If we don't grant immunity, those people won't talk, so we have no evidence,” Gallegos said. “It doesn't feel good to us either. But in the spectrum of wrongs, the person pulling the trigger is a lot worse than the others.”

Barger was returned to the Humboldt County jail, and awaits sentencing for the vehicle theft.
He is scheduled to return to court for a pretrial hearing on the second-degree murder charge Nov. 18.

DA says no charges in CHP shooting

DA says no charges in CHP shooting

EUREKA -- The Humboldt County District Attorney's Office has determined that the CHP officer who shot and injured Rodney Bartow in September on Snow Camp Road acted with reasonable cause, and that the shooting was legally justified.

At a press conference held Wednesday, the decision was announced.

” ... I have concluded that (CHP) Officer (Jeff) Goodwin has reasonable cause to believe that Mr. Bartow was resisting arrest, committing an aggravated assault, and was engaged in conduct that posed an immediate threat of serious physical injury or death to himself and/or others,” said a press release from the office of District Attorney Paul Gallegos. “Specifically, he was placed in a tense, highly uncertain and rapidly evolving situation. He made a split second judgment intended first to avoid to avoid the use of force and then, facing an immediate threat of serious physical injury or death to himself or others, to use deadly force.”

Bartow, 54, is currently being prosecuted for alleged crimes committed at the time of the shooting. He was shot after he drove in reverse toward a CHP officer after coming to a locked gate near Korbel.

The chase started after someone called to report apossible drunken driver near a Blue Lake gas station.
The CHP officer found the car, but Bartow took off when the officer tried to pull him over. Bartow lead the officer on Blue Lake Boulevard, through Korbel and almost to Snow Camp before reaching the gate.

Bartow was shot in the shoulder. He was eventually handcuffed and taken to a Redding hospital, where he was treated and released into police custody.
