Speedy trial - UPDATED

TS Gundersen trial jury selection slated to begin
Jury selection is slated to start today in former Blue Lake Police Chief David Gundersen's rape trial, and it's expected to be a long, thorough process.
”It would be mind-boggling if it only took two weeks,” District Attorney Paul Gallegos said Friday, adding that he expects the selection process to last about a month.

  1. The questions are going to be amusing. First of all, anyone who takes a prescription sleep aid is off the jury. And anyone who hasn't been asleep, aided or otherwise, for 6 months, is off the jury.

  2. Hearing about the case doesn't mean you can't serve. Fair minded people are able to set aside what they have heard outside a courtroom and render a fair verdict based on the evidence presented. A change of venue may be granted if they can't find enough people who can render a fair decision which would, of course, then be the only way justice could be served in this case. I hope he can be tried here due to the increase expense of a change of venue.

  4. one problem with "hearing " about this case is that in several ways the DA arguably violated certain rules about pretrial publicity, and if the DA can do that with impunity, then those rules are meaningless. A judge might well rule that the DA's improprieties as well as the difficulty in overcoming what the defense calls unfair coverage mandate a change in venue. Otherwise the DA is free to "try the case in the media", knowing there will be no penalty.

  5. I totally agree with you 10:22. Gags doesn’t give a damn about rules, the law or anything else except for reading about himself in the press. And he really doesn’t care how it reads as long as he is in the press. The apathetic in this county have allowed his flagrant abuse of power. This man has lied to and hurt victims of crime and their families. He abuses constitutional rights of the accused. You can’t say he favors defendants over victims nor victims over defendants. Everyone - both defendants and victims are considered collateral to Gags’ own agenda which is feeding from the public trough while doing as little as possible, lying to the public and abusing his staff.

  6. The last time I got called for jury duty it was for some kind of a probable rape case and everyone filled out questionnaires. Even though what I anwered would not have put me on the jury, I was kept there while the attorneys interviewed lots of potential jurors and alternates. One woman that was intervied to be a juror (not one of the alternates) did not make the jury. I happened to walk down the front steps of the courthouse with her when we were all dismissed and she said she could tell by looking at the person that he was guilty. She had her mind made up and wanted to be on that jury. How fair is that? The Gunderson case has been in the newspapers a lot but who knows if everything that got quoted is true or not. There are lots of things that a jury is not allowed to hear that could influence them while a trial is going on. Sometimes what they can't hear would be the reason not to convict. Not saying that is what would happen in this case but a change of venue might be the best here.

  7. Do you always jump to conclusions based on the last sentence you read 9:46? The sentence previous to the last one said "A change of venue may be granted if they can't find enough people who can render a fair decision which would, of course, then be the only way justice could be served in this case." Let's hope no one as dumb as you ever serves on a jury since you can't remember from one sentence to the next.

  13. My entire post was logical, fair and accurate. You jumped on the last sentence of why I hoped a change of venue wouldn't be necessary, made a fool out yourself and aren't man enough to admit it. Grow the fuck up and apologize.

  14. 3:09 - you are rather a snot aren't you. Perhaps you think that your whole post was fair and accurate, but you can't admit that perhaps you could have worded it differently.

    My only response is: quit throwing a tantrum and acting like a six year old - which I have already suggested at 2:25 and at 9:02.

    As I said before little man - Now might I suggest that you get over it and move on. There are much more pressing matters at hand.
