Benjamin Carter case close to resolution

Jury trial dates were expected to be set today. Instead, (Carter's defense attorney) Mr. Acosta told Judge John Feeney that he had spoken to (DDA) Mr. Brownfield before court and the case is close to resolution. - John Chiv/Words Worth

  1. Is he pleading to Murder? Because that is what he is charged with. He fled. He called Lost Coast Outpost to talk about the crime rather than call law enforcement. There was a dead guy in the motel room. Because he took so long to go in custody, it will be impossible to see if there is some kind of self defense issue. This will be an important test for the new DA. If he pleads to Murder, and gets life, the way Vincent Sanchez did, then that will be acceptable. If he does not plead to Murder, and he gets manslaughter, even with a firearm involved and a prior strike, it will be interesting to see how much time he gets. It could go up to 70 years. Doubt he pleads to that. Again, why are they afraid of taking case to trial? He fled. He apparently committed Arson. Probably designed to cover up the crime. I am sorry this guy is guilty of Murder. He should plead to that or go to trial for that.

    2. The body was not in the motel room. They arrested Carter's wife at a motel. The body, according to preliminary hearing testimony was in a trailer and then allegedly Carter and others disposed of it.

      I feel the same way you do and we do not know what the resolution is, if it will be resolved and if a Judge will accept the proposed resolution.
