☛TS Convicted sex offender faces 6 years, deportation

A Mexican national, who will face deportation for a second time after serving an expected six-year sentence, pleaded no contest Monday to allegations he sexually abused his 8-year-old daughter.

Isaias Felix-Romero, 33, pleaded no contest to the sexual abuse of his daughter-- referred to as Jane Doe-- according to Deputy District Attorney Arnold Klein.

Eight years ago Felix-Romero was convicted of unlawful intercourse with a 13-year-old minor, the mother of Jane Doe. Felix-Romero later married Jane Doe's mother.,,,

...In early September, Felix-Romero was arrested as part of a U.S. Immigration and Customs Enforcement raid on Sun Valley Floral Farms.

ICE reported Felix-Romero has already been deported from the United States once, and he will be detained and ultimately deported by ICE after his sentence is completed.

”We definitely have flagged this case for follow-up, and a detainer will be lodged against the individual,” said ICE Communications Director Virginia Kice.

Felix-Romero's previous deportation may be reinstated, which would result in expedited removal. Because of Felix-Romero's criminal history and felony reentry, his case is subject to review by the Department of Justice and the U.S. Attorney's Office....

This report says he pled "no contest to allegations..." but does not say what the CHARGES (Penal Code Sections), and resultant minimum and maximum penalties were.

Reminiscent of the Martinez-Hernandez case except this time, the immigration authorities really have been contacted. The similarities are incredible. Child victim, turned bride, second victim the child born of that abuse.

But in 6, really 3, years he'll get to rape another 8 year old, and next time, he may not want to leave any witnesses behind.)

This is why Gallegos "losing" virtually all of our experienced prosecutors matters. He wasn't then, and isn't now, capable of handling these cases properly.

  1. With this particular undocumented visitor to our country, I suggest that the means of delivery to his country of origin be out the back door of a C130 at 20,000 feet, sans parachute.

    He won't suffer recidivism that way.

  2. Too high. Might lose consciousness from anoxia. Make it 15,000.
    Not sure why he got the mid term instead of the max of 8, esp with a prior. Not sure why he was allowed to plead nolo instead of admitting guilt. Depending on what he did to her,
    6 could be a gift. See 288.7 of the Penal Code.

  4. this guy was facing 25 to life. I will say that 6 years is a gift. Now he will be out in about 3 years then deported and should make it back to the states in about four years to rape another child.

    Thank you G and thank you Klien for another irresponsible plea bargain that doesn't remotely do justice for our children.

  5. I'm a little disturbed by it, too.

    Martinez-Hernandez was also a serial child rapist, whose first young victim bore his next, if I remember correctly.

    But I am more disturbed that friends of mine brush it aside, oh, so what? - when they used to care about things like this, now, because it is the precccious Paul, it is to be swept under the rug.

  7. Remember this, from the Martinez-hernandez case "... Keat added a note that there were a lot of stackable charges which would put Martinez-Hernandez away for hundreds of years. "It's probably going to turn out that there are a lot of stackable 288b's [sex offense counts] that can get him into the century club" -- or 100 years in prison. NCJ..."

    Wonder how many stackable 288b's there were this time.

  8. He was originally charged with sodomy. Sodomy of a child under 10 is punishable by 25 to life
    per 288.7 of the code. This guy, this repeater, got 6?

    Why? That's the same sentence he would get for
    a first offense rape of a drunk adult woman.

  9. Yeah. This guy should have gone away for a very very long long time.

    This is why Gallegos' firing of Allison Jackson was such a horrible loss for this County. We had an experienced child abuse prosecutor, who was known for putting guys like this away for 100 years +. He had Drew Isaac, and Rob Wade, both excellent top notch seasoned prosecutors. They are ALL gone now. Because of Gallegos.

    During his campaign, Gallegos droned on and on about his 'philosophy' that no one in 'his' office was allowed to focus on one area for prosecution, that he liked to 'move them around' - he was not into letting anyone specialize in any one area.

    So now, he pleas out another one, because he doesn't have a single person in that office capable of taking this kind of case on.

    No - that's not exactly true. He has one. He had her assigned to child abuse cases at one point. Then it was revealed that no cases were happening.

    And, though he called her the finest prosecutor he had ever known, or words to that effect, he abruptly pulled her off child abuse and stuck in good old "YouGoFree.com" Jeffrey Schwartz, who did nothing.

    The CAST (Child Abuse Services team) has been decimated, and even though he was put on notice about that during the campaign, he did nothing to try to fix it, then, or since.

    He likes to cover up by saying it is a win that the guy will be off the streets for a couple of years.

    For raping an impregnating a 13 yr old (or less) girl, getting caught, and sent away, and then coming back to rape the 13 yr old's (and his) own much YOUNGER daughter.

    But, hey. He went after Palco. And, he likes pot.

    Yippee Yay.

  10. To be fair, there may have been problems with the case that are not immediately apparent. Victims are reluctant to testify or can't recall important details, etc. The problems is that the various events Rose has chronicled here erode my faith in the DA's office. Besides, lets face it, it is hard to get a guy to plead to a life count. On the other hand, it does happen, if you saw yesterday's Press Democrat (I think it's still available online) with a cameo by a Humboldt alum.

  11. That is why the CAST unit was so important. That is why having a trained, experienced, successful prosecutor handling the case is so important.

    Gallegos' record is beyond dismal.

    I repeat! He wasn't then, and isn't now, capable of handling these cases properly.

    It matters. It should matter. But if you look at the TS, that story has almost no comments. That's why he gets away with it.

  12. Word is that Wade is doing homicides in Santa Cruz, and Isaac is down the hall as a sex crimes prosecutor. Both supervisors.
    Surely Santa Cruz is grateful for all that training Humboldt paid for.

  13. With Gallegos it is always the victim didn't want to testify. Think Whitethorn rapists and every child abuse case that has come down the pike. The victim didn't want to testify.

    But when he had one who really didn't want to testify, and I mean really didn't want to testify, even writing to the Attorney General about how she didn't want to testify, what did he do?

    He threatened her and forced her to testify.

  14. In kid cases, one great benefit of CAST, and of the experienced people who staffed it, was that young victims DID NOT refuse to testify. They and their families came to trust the prosecutors, who took time, lots of time, to meet with young victims.
    Guess it's a matter of priorities.

  15. Just think !! If Klien got a six year plea bargain just think what Allison Jackson could have done? Or Andrew Issac or Rob Wade or Worth Dikeman or Heather Gimle or Ammon Fitz ............. and so on.

    Not trying to get in digs on all the deputy DAs because they had no one to train them, mentor them, show them the right way.

  16. Allison Jackson was know for putting guys like that in "The Century Club" that Keat refers to. Meaning she got them 100+ year sentences.
