Just curious

How's the DA going to handle code enforcement?

Looks like one of his DDAs lives off the grid. Wonder if she has all her permits in a row? And if not...

Recently, she ...moved from a comfortable home in East Sacramento to a cabin without electricity or running water near Ferndale in Humboldt County. Their three-room cabin, on 80 acres that they purchased in 2003, perches on a 1,300-foot-high ridge. Through their large windows, they can gaze at the Pacific Ocean, the mouth of the Eel River and Humboldt Bay.

But life often gets in the way of idyllic ocean gazing. Just getting to their cabin is a chore: Driving three miles from Ferndale on a steep, twisting stretch of road known locally as “The Wildcat,” they must turn onto a dirt road and travel a quarter-mile, then hike the last 150 yards to their house by foot along an often-muddy trail. Once they’re home, the work doesn’t stop: They have to generate their own heat and power and supply their own water. How do they do it? They warm the cabin and cook their meals with wood, finding an abundant supply on their land. “Gathering wood is really a lot of work,” says (her husband), 50. “But hey, I’m in better shape now than when I was going to Alhambra Athletic Club.”

Water comes from a spring that (he) dug himself. Around Thanksgiving, an old septic tank on the property failed; they now use what (he) delicately describes as “alternative waste-handling approaches” that include composting. “This simple system works great for us,” he says, “and it feels good not to waste the water used to flush.”

They get hot water from a small gas water heater powered by propane gas. To refill the propane tank, (he) drives to Fortuna, about 20 minutes away. The family also generates its own electricity, using a system of spinning wind turbines and rooftop panels that absorb sunlight and convert it to electricity that then is stored in batteries.

The McKimmy family lives “off the grid,” going without connections to public utilities such as electricity, water and sewage.

  1. Isn't that sweet. Is this gal McKimmy one of PVG's new DDA's ? If so maybe she can prosecute environmental crimes like dope growers spilling diesel and oil ?

    Naw, Paul v. Gallegos would not want to do that as it would piss off most of the dope growers. And like it or not the dope growers are his biggest supporters (financially and vocally).

    This code enforcement thing/issue is just another example of Gallegos (and the B.O.P.) catering to the MARIJUANA GROWERS. PVG doesn't care if they are growing marijuana, selling it all over, not paying taxes, and basically being an open sore on society's backside. PVG doesn't care because they got him elelcted, and they keep him elected. They make money and he stays in power.

  4. With regards to McKimmy, I fully support her right to live off the grid and on the land. I think it is a great thing. A real and authentic life, EXACTLY what HumCPR is advocating for, EXACTLY what the people who just testified at the Code Enforcement hearing, the CLMP folks are talking about.

    Choosing to live off the grid is a valid choice.

    She should bring a very interesting perspective to any prosecutions of people like the Yee Haw Ranch guy.

    She may be the clearest proof that they should not be prosecuted at all.

    That's an interesting double edged sword.

    But what she also demonstrates is just how WRONG Mark Lovleace's stance is, his forced infill Plan A.

  5. Hooray for the McKimmies. I don't know what the zoning is for their area. It depends on availability of services. If it's an "owner-builder" area they can build anything they wish. Living off grid is very satisfying. We did it for 10 years and would still be doing it in Weitchpec if the DA had prosecuted the felon (grower) who kept shooting at us.

It is about when lots of people move to rural areas and then, by their numbers, demand and get the services that the homesteaders decided to live without who then have to pay for them, along with every other taxpayer in Humboldt County.

    Of course, you don't want to understand and would rather continue with your strawman games, but strawmen don't have any brains so that is the only opponent you have a chance of defeating.

  7. john desidere is no libertarian. while he is in charge of permit enforcement, regulations will be strictly enforced. thats just how it is. i know john, he is not unreasonable, but he wont let some intimidation stop him from doing what he thinks he was hired to do.

    im libertarian minded, so i dont agree with john about much, but i think that this issue is being blown out of proportion. NO ONE is saying that people shouldnt be allowed to live off the grid.

  9. theo, I agree John is not a bad man. He's just doing a bad job,poorly. The problem is that "he's doing what he thinks he was hired to do". What is that? To indirectly help marl lovelace force us all into some eco-groovy yuktopia of infill,walkability and dependence on government. That's the real issue and where true libertarians won't follow you,John or mark. The issue isn't being blown out of porportion theo. It is a true horor waiting to go atomic. Every property owner in this county faces a great peril if the citizens committee can't put the "rights" and humanity back in property rights. We will not live in a lovelace yuktopia.

    talk about paranoia....i own property, im not foreseeing an atomic war here. thats why i am proceeding on my projects and not whining about theoretical constructs regarding property rights. there is only one way to develop property, ONE project at a time. its always a fight. if you owned property and have developed it, you would know that.

  12. I agree. Code Enforcement is a separate issue from the General Plan. And Desadier is in a completely different arena.

    Some Code Enforcement is necessary. And I can understand why building inspectors/Code Enforcement/Assessors might want armed escorts when going into some rural areas because of the prevalence of dope growers and the possibility of armed dope growers. Not just in SoHum, but mostly there.

    It's a tough issue - you can't have innocent people being rousted at gunpoint. And, You want some rules enforced.

    Those who are going to try to sort this one out will have a difficult job.

    I was very impressed with Bonnie Blackberry and the CLMP - the quality of their words and points and presentations. The respect and consideration they gave. It will be interesting to see if a people friendly, freedom preserving solution can be found.

  14. Code enforcement and the General plan are not seperate issues. To think that shows either a lack of understanding or deception. The General Plan is quietly changing zone designations,building code standards,septic requirements,gray water,etc,etc,etc. A unit that pays its way from fines and foreclosures it developes is a ticking bomb. theo you may not care about many who are on low or fixed incomes or are just happy in their simple lifestyle but I can tell you when were forced from our meger homes it atomic warfare to us.

  17. I don't know 7:47. It's one of those things each person decides. I have removed phone numbers from listserve messages by Salzman and Miller with mixed feelings. Because those listserves aren't just sent to 5 or 6 close friends. They are a form of viral email, sent to hundreds of not thousands of people. If they put their number on that kind of message, that is their choice. And is certainly intended to generate a response. AND, those listserves have been used to galvanize attacks on opponents. NO question.

    Aside from that - yes, I have had problems as a result of using my name. But I think it is important for me to do so.

    And I have seen others smeared far worse than anything that has been done to Mr. Quilez. By Salzman and by Miller. Any one who stands in the way gets publicly vilified.

    Never have heard you, whoever you are, anonymous, say anything about that. Not once.

Do you have any specific information about Salzman or Miller (or any other progressive) giving out home phone numbers and encouraging people to harrass anyone with late night, auto dialer calls and calling them obscene names which call into question their sexual orientation or just the general complaint of "smears?"

    Who exactly are you accusing over the Debi August mess? Wasn't it the grand jury who started the investigation on her based on citizen complaints? The same grand jury that was so critical of Gallegos? The same grand jury whose misconduct regarding records (which weren't turned over to the DA) caused the August case to be dropped?

  29. Mel Berti was on whose side? There were lots of conservatives in Fortuna very upset over her work on the Smith subdivision and the obvious conflict of interest. If it weren't for the malfeasance of the very same grand jury whose report on PVG so prominent on this blog, she likely would have been convicted. It's funny that you think only progressives have issues with conflicts of interest. Do you even know what the Debi August case was about or what happened? Somehow I doubt it.

    If you're good you can find the AEB/Gallegos listserve being used to exhort people to write letters to the editor AGAINST Debi August and supporting your boy Paul. Giving them the talking points. Yeah, very nice.

    Were the complaints that August was involved in a conflict of interest true? Did the investigation start before Stoen even worked at the DA's office? Was the investigation started by the grand jury after complaints from Mel Berti and others about the apparent conflict? Did Debi August say she was going to list those properties? Did she say she was wrong and apologize for being involved in this issue? You can blame anyone you want for any number of things which occurred. That doesn't mean that the DA's office was responsible for it.

    As I stated at the very beginning, 2 wrongs don't make a right. To viciously and obscenely attack someone, post their home phone number and tell people late night calls are best for exercising their right to voice an opinion to an elected official on what they would like him to do is unconscionable. Justifying it by claiming that other people smeared people makes no sense. Are you saying that Quilez deserved it because you think August was smeared? Who smeared August? Is it a smear if it is true? She got lucky that the grand jury screwed up. She admitted that there was a conflict of interest, didn't she? How is the DA to blame for the grand jury hiding records?

I still haven't seen any evidence of a smear campaign against August or that anyone accused her of doing anything she didn't do.

  39. They are trying to justify the attack on Quilez by claiming progressives do this type of thing all the time, Theo. But the only instance they can give is Debi August but can't explain what that has to do with progressives or smears. Her conflict of interest was quite clear, she was informed that it was a conflict of interest but continued to represent the developer and use her position on the city council to do so. Only a "development at any cost" person would even deny that. Maybe they think that anyone who has any issues over what our elected officials do in the way of helping developers has to be a progressive. I don't get it.

  40. We've covered the August thing here in great detail many times. Citizens complained. An investigation occurred, and the normal outcome would have been a scathing report, leaving the Fortuna City Council to deal with the issue, possible voting to censure her.

    What happened instead was Stoen directed the Grand Jury into a rarely used Accusation against her, with the intent of removing her from office. He charged her with 5 counts, which included everything he could think of - like failing to file FPPC forms accurately and on time.

    4 of the 5 charges were tossed by a judge before any trial.

    Debi August maintained her innocence and she fought for it. It cost her dearly.

    In the course of that whole thing, Salzman sent out the viral email I mentioned above, asking the Orks to send letters against her.

    Miller wrote letters condemning Judith Schmidt, the Grand Jury forewoman who came forward to say she thought something was wrong with the way Gallegos and Stoen were handling things.

    "I didn't trust him." Remember the headline?

    BUT - THAT has nothing to do with what a blogger has posted on his/her/their blog. If you don't like it, go complain over there.

    But the August case was a definite example of the selective prosecution this DA engages in.

  41. Except the Grand Jury investigation of August started before Stoen was even hired. They were investigating her on their own and hid the evidence of that. How is the DA's office, Stoen, Miller, or Salzman to blame for that? People have a right to vilify those whose corruption becomes evident, like August. It isn't a smear if it is true.

  42. The INVESTIGATION was normal. A report, even a scathing report, is normal. The accusation process was not.

    It's worth noting, actually that Gallegos himself was found to have violated FPPC rules and paid one of the highest fines ever in this county.

    As for conflict of interest - what do you think about Gallegos filing the PL suit for his supporters?

  43. Debi August was a target because of her VERY public comments against Gagellgos and Stoen, when Stoen appeared before the Fortuna city council and ASKED the COUNCIL NOT to support the DA RECALL. This incident was well documented in the California Layer magazine.

    An excellent example of a public official abusing their position and power. And to think Gallegos is prosecuting former EPD chief Douglas. Gallegos, and team, are trying to keep the EPD in line. And by in line I don't mean they are doing anything wrong. The EPD is getting paid back for supporting Dikeman and for public criticism of Gallegos and some of his clowns (Stoen, Schwartz, Klien). Kind of makes you wonder why the new EPD chief is so buddy buddy with Gallegos?

  44. DA's file complaints all the time that don't pan out. If all the charges they filed were valid we wouldn't need judges and juries. He obviously thought, for good reason, that PALCO's false declarations were evidence of fraud, their forwarding the corrected information to the wrong office later notwithstanding.

    You still haven't backed up your claim that progressives smear people with any evidence of progressives doing anything even remotely as nasty as posting someone's home phone number and encouraging late night harrassing calls. Sending out e-mails and letters encouraging letters is done by organizations and people all the time regardless of their political slant.

    It has been shown definitively that August was guilty of malfeasance due to her knowledge she was engaged in a conflict of interest but continued that involvement. The people who complained about her had every right to do so and also to try to garner support from others.

    btw, I didn't blame you for the nastiness at the Mirror, just pointed it out because you so often claim that there is no valid excuse for bloggers not to use their real names. You then tried to justify that nastiness with the claim that progressives do it too.

I do believe (political) bloggers should use their names - and I do agree that there seems to be a local code of ethics that says don't post home addresses and phone numbers, even though the subjects often use both in their listserve viral emails. There's also a "don't post email addresses in full" code that is generally adhered to with that same caveat.

    Frankly I think I could post video of Gallegos murdering a homeless woman on the Arcata Plaza in broad daylight and you would still defend him, so I don't think there's much point in carrying this conversation further.

    Let's just say that those attacks I mentioned, along with many others, stab just as deeply into the heart of the recipient as you seem to think the simple posting of a phone number has to Carlos Quilez. Time may soften the blow, and to an outside observer it may appear to be a so what> - but to the target of the attack it is anything but.

    You'll excuse any and all. I've said that Carlos has a right to his opinion, as does the Mirror, and it is fair to point out that Carlos' letter is not just that of an individual but is part of an orchestrated campaign in the fight for political advantage.

    Roger was one who stood in the way of that faction, and they are overjoyed at the prospect of his being removed, albeit tragically, and they are quick to move to prevent anything that might interfere with that newfound advantage.

    I am not defending Gallegos, but pointing out that ALL DA's make mistakes and lose cases. Blaming him for the August fiasco shows you have no perspective or balance. Blaming progressives for Gallegos is another example. I believe, correct me if I am wrong, that a lot of conservatives also supported Gallegos, including Rob Arkley.

    But I do think Gallegos is a lousy, inept, self serving, corrupt public official. And I do agree with Rose, that unless Mike Wallace and the entire 60 Minutes crew got Gallegos on tape torturing puppies you and your group would defend him.

    The PALCO suit is a prime example. He was advised (by his staff) that there was no case. But to appease Kem Miller et al he went ahead. He gets whacked by the court, he appeals, he gets whacked by the appealate court, he goes for the third strike and gets whacked again. He knew it was lame and not winable. He did it anyway, costing who knows how much in county funds and man hours. All to please his supporters (Ken Mille and all) and to be a folk hero to the local Humboldt Only lunatic fringe.

    Yes Arkley gave money and support to Gallegos and I would bet he feels bad about it now, BIG mistake.

    Step away from all the politics for a minute. Do you really think Gallegos is doing a good job as the District Attorney? I mean really, on the merits of what he has done or not done? Just his lack of basic managment skills would be enough to get him fired/dismissed in a non elected position.

    He hired Tim Stoen to be his number 2 !!!! That should have sent RED FLAGS up to any rational person. Stoen had sooooooo much negative baggage, many blame him for the Jonestown mass sucide. Gallegos fired two of the best DA's Humboldt has ever had just becasue he didn't like them. AND several other DDA's left because they were career/professional prosecutors that enjoyed being prosecutors but couldn't work for PVG any longer , not the dreg's like Yougofree, Jose, Jose's girlfriend, the nut with the multicolored hair, and the list goes on.

    How many vacations does Gallegos take a year? Timeshares in Mexico and Hawaii? How does he pay for all his vacations? I'm curious. Do some of his "supporters" assist him on his vacations, letting him use a timeshare or vacation rental?

    How is it that Rose never got all her stat's on CAST cases?

    We'll see what happens. He's put alot into the prosecution of the EPD chief/Lt AND Gunderson. The two are extremely different but each high profile. I have confidence that the case against the EPD brass will be dismissed or if by chance it goes to court they will be exonerated. This Gunderson thing I'm not too sure of. I'd like Gunderson to get his just deserts but something just seems kind of "stinky" about that case, the investigation and victims. Time will tell.

    DID I MENTION THE PLAGIARISM??? That was really pathetic.

  54. Maybe you are confused because you jumped into a conversation I was having with Rose. As I have said MANY MANY TIMES, I am NOT a Gallegos supporter. Rose continues to conflate Gallegos with progressives which I have tried over and over again to point out isn't the case. One of the most conservative people in our county gave Gallegos many thousands of dollars for his campaign, certainly more than any other contributor.

  55. What I have said repeatedly is that well meaning thoughtful intelligent caring people looked at the Palco lawsuit and the Recall and saw something that rightfully horrified them. They saw what was portrayed - a company trying to buy their way out of a lawsuit. And they did the right thing.

    But what they never got a glimpse of was the other side.

    The well-funded dedicated decades-long effort to get that very company, the unending lawsuits, the lobbying in the halls of Congress, and the final securing of a DA who would drive home a stake.

    They saw David v Goliath, and never saw the equally large Goliath on the other side. They never heard about Shellenberger, Fenton Communications, or any of the things that went along with it.

    Rob Arkley was one of those who saw something horrific and he put up money to help.

    Only when he realized that something wasn't quite right, and there was some sort of parting of the ways between he and the Salzman gang, a public denunciation of Salzman by Rob - "I see how you operate" I believe were the words - only then did Rob suddenly become the villain, and the attacks begin on him.

    And those same people who took his money now vilify him when he uses it in similar goings on, to try to help right a wrong. They vilify him no matter what he does. It defies rational thought, and yet it goes on. I wish he hadn't supported Gallegos, but I understand the reasons he did so. He didn't like farmer in the first place - many didin't. And in the Recall, he saw injustice. It's pretty clear.

    I've watched it. It's easy to see.

  56. Personally I think we are all too focusined on something that means nothing. Labels. Democrat, Republican. Progressive (as if that is a party) - the Star Bellied Sneetches all.

    Run everybody through the machine a couple half dozen times until no one remembers what the stupid labels and stars mean, and you will find we are not all that dissimilar, and maybe some rational thought could prevail.   68. A young woman was about to finish her first year of college. Like so many others her age she considered herself to be a very liberal Democrat and was for distribution of all wealth. She felt deeply ashamed that her Father was a rather staunch Republican, which she expressed openly.

    One day she was challenging her father on his beliefs and his opposition to higher taxes on the rich & more welfare programs. In the middle of her heartfelt diatribe, based upon the lectures she had from her far left professors at her school, he stopped her and asked her point blank, how she was doing in school.

    She answered rather haughtily that she had a 4.0 GPA, and let him know that it was tough to maintain. That she had to study all the time, never had time to go out and party like other people she knew. She didn't even have time for a boyfriend and didn't really have many college friends. All her time was spent studying because she was taking a more difficult curriculum.

    Her father listened and then asked, "How is your friend Mary?"

    She replied, "Mary is barely getting by", she continued. "All she has is barely a 2.0 GPA. And all she takes are easy classes and she never studies." To explain further she continued emotionally, "And Mary is so very popular on campus, college for her is a blast. She goes to all the parties all the time and very often doesn't even show up for classes because she is too hung over."

    Her father then asked his daughter, "Why don't you go to the Dean's office and ask him to deduct a 1.0 off your 4.0 GPA and give it to your friend whom only had a 2.0." He continued, "That way you will both have a 3.0 GPA and certainly that would be a fair equal distribution of GPA."

    The daughter visibly shocked by the father's suggestion angrily fired back, That wouldn't be fair! I worked really hard for mine, I did without and Mary has done little or nothing. She played while I worked real hard!"

    The father slowly smiled and said, "Welcome to the Republican Party."

I suspect it is because you like your nose in everyone else's business and enjoy the personal attacks. But that's just a guess. You only seem to want to know who people are who post anonymously who you disagree with and that does raise red flags. When people aren't satisfied with just agreeing to disagree and have to take it further to "reach out and touch someone" with harrassing phone calls, they are mentally ill and don't need to know who people are. Since no one can control who accesses the information from a blog or what they do with that information, anonymity is a better choice for those who don't want to be "touched" either with a phone call or other forms of crazy mischief. But like every other difference of opinion here, you will pretend there is no basis, get sarcastic or rude and there can be no meeting of the minds even to agree to disagree. Rose, I've been reading your blog for awhile now - what I find troubling is that regardless of a person's position on PVG - unless and until a person knows about the detailed facts of a particular case, how can anyone make an informed comment about how it was handled? The personal attacks against those who work in that office are simply obscene. Some people moved here just wanting to live in the area and feel a strong work ethic towards community service - that's what prosecutors (and public defenders) do - a valuable community service. I have often cringed at the vile and seemingly baseless mud slinging at many of the deputy d.a.s - from where does this animosity come?

I have tried to point out that no one does everything right or wrong, but they can't ever admit anything was done properly.     by the way, wont the general plan update be approved before the new supervisor gets in power? if so, dont use that argument.
