ReplyDeleteWhat has been said is that Gallegos himself has no business being involved in this case given the revelation that the ex-wife figures so prominently in the accusation and investigation, and that she is involved in an on-going custody dispute with Gundersen AND she is represented by Gallegos' wife.
That smacks of conflict of interest and impropriety for Gallegos to prosecute this case.
That's what has been said, along with - wait for the evidence to come in.
You can stop trying to spin it. As the evidence is emerging, it appears that Gallegos did not have his case prepared before the arrest, is figuring it out as he goes along, and that the ex-wife's role is significant.
Nothing there has made any assumptions as to Gundersen's guilt or innocence, other than that he is to be presumed Innocent until proven guilty.
If there really is a conflict of interest, as you claim, why hasn't Clanton tried to get Gallegos removed from the case? What's he waiting for?

It appears that Gallegos had plenty of evidence to convince a judge to grant the initial arrest warrent and search warrents. He acted in a timely and expeditious manner to have the suspect arrested and incarcerated so that the suspect would not have the opportunity to continue his allegedly very serious ongoing crime spree. As further evidence has surfaced in the course of the investigation, more charges have been added, something that is quite commonplace in investigations.
Well, 11:06, according to the story Clanton is waiting for discovery. And he may not want PVG removed from the case because he would rather have PVG try the case then someone from the AG's office.
ReplyDeleteFrom what I have read, PVG can probably get this past prelim; he does not need the current spouse/vic to do that, because he can use the tape of her interview. Even if he gets no holding order on the charges involving current spouse, he's got some nifty other charges to go on with.
Whatever happens, he's ruined DG's life; perhaps DG deserves that, I don't know. Just because I think PVG is a crappy DA doesn't mean that DG isn't a serial rapist - even a blind pig finds an acorn now and then. But the manner in which his office is proceeding is distinctly half-assed - it is quite possible, as someone noted on another thread, that the charges that stick will be the bcharges developed after the arrest and search warrant.

ReplyDeleteReally? Well, what would you have done differently?
Wait to make the initial arrest, giving more time for the suspect to destroy evidence, intimidate (or maybe sedate) the alleged victim, fetch his illegal machine gun, etc.?
Or not charge the additional crimes when the evidence was uncovered in the post-arrest searches of the sustpect's residence and car?
Or drop all the charges because after the suspect illegally contacted the alleged victim from jail, she has now described the sex as "consensual," though not repudiating the facts that she initially reported?
Nothing that has been alleged indicates that there was any imminent danger - the charges are old. Seems to me that the case should have been solidified prior to arrest. But - I'm sure your Golden Boy knows what he is doing, and is getting advice from seasoned prosecutors and investigators prior to making his decisions. (Oh, wait, they're all gone. Scratch that.)
ReplyDeleteLike I have said all along, people should wait until the facts are known and it should be tried in the courtroom, not the press.
Gallegos is the one who said without a witness he didn't have a case, and threatening an alleged rape victim is not cool, dragging her into court and threatening her is against everything rape crisis counsels rape victims to expect.
The real reason there are questions here are Gallegos' own doing, and actually have very little to do with Gundersen.

Rose, you are right on the cusp of the biggest conspiracy of them all! I must tell you quickly, before they pollute my life juices...
Chief Gunderson is a Nam veteran, who was stationed in Dien Phet Rei in August 1971. The installation in that sector was a test facility for a project known as Arkon VII. Chief Gunderson was privileged to Arkon VII test files, and is also one of the people entrusted with the command codes for the continuity of government program. In essence, if necessary, Chief Gunderson could take control of Arkon VII during a time of crisis.
Enter Paul Gallegos. Turns out Cheri Moore left one more phone message than shows up on the police records. She made a frantic and cryptic call to the DA shortly before her demise. "Paul, Paul! Oh my god Paul! They're going to kill me! Listen, Theres something I need to tell you! Arkon VII -- It's the Global Positioning System!" The phone cut out as the police raises the apartment.
Paul Gallegos now had the information he needed. Chief Gunderson had the command codes for the GPS system! If Paul could extract that information, theres nothing that could stop him. The international war machine could be turned and used against his opposition here at home in Humboldt County! USED AGAINST YOU ROSE!
Quickly Rose, Gather up your team Of Fred Mangels and Stephen Lewis! You must get Gunderson out of jail Rose! Before Gallegos can crack him and get the GPS Codes!!!

Assuming, for a moment, that most of what Gallegos alleges are true I have only this to say: If he only prosecuted other criminals (non-police) with the same fervor then Humboldt County would be a much safer place to live!

These are not old charges. The current wife claimed in the initial interview that he had raped her many times, most recently the night before. The other non-rape felonies are also not old. The charges for illegal weapons and drugs occurred after he was arrested for the rapes.

ReplyDeleteGundersen is charged with possession of a class III firearm (machine gun) and an "unregistered" hand gun? Unless the "silencer" was attached to the pistol there is no requirement that the pistol itself be registered. These are some pretty interesting items of "evidence".
ReplyDeleteGetting the current wife's allegations past prelim is a "be careful what you wish for" issue, if it will only emphasize that the DA is ignoring the rights given to rape victims in 1219 subd (b).

Especially since Gallegos got out of the DeFillipis stalking case (in which Deputy Morey tanked his career although PVG could not make perjury stick in THAT cop prosecution)
because his spouse represented the
victim in that matter.
