Gundersen case headed to trial

In a closed courtroom, a preliminary hearing date of Feb. 27 at 8:30 a.m. was confirmed. Deputy District Attorney Kelly Neel represented the prosecution, expected to be personally led by District Attorney Paul Gallegos.

  1. Actually, it's headed to prelim.
    That should send it to trial, assuming the victim is "on board" for the prosecution. Even if she's not, the case can get pretty close to trial, but it's almost impossible to prove rape if the victim does not take the stand at some point and make the elements of the case. So if the DA chooses to present a case and get a holding order, he's either playing poker publicly, or he thinks he
    has a case.
